Invoice date July 23, 2022, *********** A cheque was written for ********** July 26, 2022 with ******* being withheld for deficiencies that were to be fixed as soon as possible. Landscaping of the front and back yard started 06Jun22 after many delays due to weather and available workers. The last day of employees before the invoice was July 24, 2022 The landscaping has not been completed properly. The bender board is popping up everywhere and is a tripping hazard to us and guests so a liability for us as homeowners. The irrigation has not been properly put in and upon further inspection is leaking and seeping water throughout the left back garden. There appears to also be a leak in the front garden judging by the water staining on the front pathway that is always there. Digging down to plant plants, you come to mud very quickly. They did not scrap material back properly so grass and weed is coming through the garden and hedge which has been buried in 6-10" of bark mulch. I have spent over 6 weeks weeding almost every day to no avail. The pond leaked, they tried to repair it unsuccessfully. I bought new tubing and they attempted to fix; but did not have the right materials so they left me with a leaking pond, would not come back, so I had to go into town, find the materials needed and with a lot of help from ********* managed to fix the leak myself. They came back to put more stakes in the bender board; but did not bring enough. They also tried repairing the irrigation that was not covering the lawn properly; but brought the wrong head so it could not be fixed. They left with a promise to come back; but never have. I have called, sent e-mails, texts and all have gone unanswered and go straight to voice mail. I need my yard fixed which is going to cost thousands which is much more than the ****** hold back. If Matt is not coming to fix his work, I need to be compensated to cover the monies I will have to pay someone else to fix our landscaping and pond.Initial Complaint

We hired Rock City landscaping company for the retaining wall and the stairs in February. Their job includes getting the permit, getting all the material, and getting the work done. In February, their estimate was $******** and asked for a 10% deposit * ********** We gave the deposit *******+ estimate cost * ******* on February 11th, February 14th, and February 1st. However, They never started the project. Whenever, I asked about process, they always blamed the city for its slowness. They said that they already applied for the permit and that they received the phone call from the Town of *********. In July, I checked with the ********* town office to ask about my permit's progress. The town office confirmed that the Rockcity Landscaping have never applied for a permit in the first place. They also confirmed that RockyCity Ladnscaping never inquired for the permit for our house to the Town of ********** **** ****** *** **** **** **** ***** ** ** *** * ******* **** * ***** *** ***** **** ****** they said that they would refund the deposit and estimate fee. However, they never answered my refund request or even attempted to get back to me. They just ignored my texts and are not getting back to me. **** **** **** **** ** ****** ******** ****** **** *** ** ******** *** **** **** **** ****** ** ***** ***** *************** ******* ** ******** ******** ** *** **** ***** **** ** ***** ******** ******* ** **** ***** **** ** **** *** ***** *** ****** *** ***** *** **** ** **** I want to get the deposit back and estimate cost from them and also let them know they should not do same thing to people.
