A ****** forklift with chains on its wheels damaged my driveway in April 2023. ****** forwarded my claim to Gallagher Bassett Canada Inc in April 2023. Today is end-May 2023 and the adjuster, Marc L., has only contacted me once. He told me at that time that ****** could not be held responsible as indicated in the contract. I contacted my lawyer and she indicated that the clauses indicated did not apply to me. I have emailed Gallagher Bassett Canada Inc on two occasions since and they are not responding. The cost to re-seal my driveway is approximately $500 and that's all I'm seeking. I want reparations to be made so I can seal my driveway and avoid any further damage, especially this winter.Business response

On May 3,2022 we were instructed by **** ***** to contact their insurance company because their delivery company ****** *******, damaged our brand new floor while pushing a stacked washer/dryer tower into a laundry closet. These two men came in with only straps to move a 350 pound unit and asked me if I had any ******* They sprayed the ****** on the floor and pushed the unit into the closet. I left my house when the floor was still wet from the ****** but when my husband returned home from work, he saw the scratches on the floor and we immobilized contacted both **** ***** and ****** *******. The insurance company asked us to provide them with pictures and an account of what had taken place on the date of delivery. They also requested two estimates which we provided for them. In the process of just under a year, we have gone through several adjusters each time they requested that we resubmit all the information which we did. When it finally came time to pay the full amount of $3076.50 they informed us that they were willing to pay half because they claim they do not have enough evidence as to who has done the damage, and that we could have done the damage ourselves. (not sure how we possibly could’ve done this since the unit was pushed into a closet with no means for us to get behind it to push it. We have provided pictures showing that the damage is not only on the outside of the closet, but also underneath the unit proving that the damage was done by them. They are refusing to look at all the evidence that we have provided for them and yesterday they informed us that our claim would expire on May 3 of this year. We are asking for the full amount for the damages that were incurred during their negligence in not having proper tools. Common sense alone should tell them that a 350 pound unit when moved an inch at a time puts a pressure of 1000lb per sq.inch of force to move it across the floor. Gallagher Bassett Canada is not an insurance company we are third party administrator acting on behalf of the **** ***** Canada. **** ***** Canada has relationships/hold harmless agreements with multiple vendors/suppliers. In this case ****** *******. ****** ******* contractually is responsible to assist the ********'s with their damages should they be liable for the alleged damages.
****** ******* as of today May 9th,2023 have advised they will compensate the complainee for the full amount of $3076.50
****** ******* will deal directly with the complainee.

Thank you for helping us with our claim. I did respond that we were happy with the response that we received regarding Gallagher Basset/****** ******* but somehow you did not receive it so I’m sending it again.
