My husband left our car a 2004 ***** **** with a mechanic for lengthy repairs and upgrades. These repairs were paid for as were the parts we had ordered. (4000$) Through no fault of our own, or to our knowledge, the mechanic had a dispute with his landlord. The landlord had all the cars on the lot, including ours, scrapped by Cash 4 Trash. As owners of the car we did not give permission for this happen, especially not after paying 4000$ for repairs. We were not informed that the car was being scrapped. Cash for Trash did not do their due diligence in asking for the ownership of the car before scrapping it. Imagine our surprise waking up one morning, 10 days before Christmas, only to find out that your car was wrongfully taken and even worse scrapped without permission of the owner. When I called Cash for Trash to find out what was going on I was told by Josh that "*******" (not the mechanic ***** ********** which we were dealing with) was a regular client and they ASSUMED the car was at the end of life or was scrapped for non-payment. They ASSUMED it was okay to scrap our car because a "Regular Client" brought it in. This is utterly unacceptable. No due diligence was followed. They did not contact the ministry of transportation to confirm if the ownership had been transferd or anything of that nature. When I emailed them for more information they said that the dispute was between us and ******* a service provider we did not even know about and then refused to provide us with the "Letter of Authorization" which they claim allowed them to scrap the car, a letter which was NEVER signed by the owner of the car, my husband. We take a lot of pride in the fact that we always follow protocol and procedure in an attempt to avoid these types of situations. ??It is unfortunate that this has happened and while we do sympathize with your situation it doesn’t mean that Cash for Trash has done anything illegal, immoral, or unjust.??
Based on your statements, it sounds as if the vehicle in question was sold from your mechanic to another garage without your authorization. That is a civil matter between you and your mechanic. ??As you know, the vehicle in question was sold to us by a third party.
