Attorney vs. lawyer: Which do you need?
The terms attorney and lawyer are often used interchangeably with each other. Both professions work within the same areas and their duties sometimes overlap. However, there is a key difference between the two professions. A dispute over hiring an attorney vs. lawyer can be easily decided based on one singular factor: whether you need to be represented in a court of law.
- Lawyers are educated in law. They have attended law school and can explain and draft legal texts to those who hire them.
- Attorneys have attended law school and passed the bar exam. They can legally represent you in court.
An attorney can act as a lawyer, but a lawyer cannot act as an attorney. If you need representation in court, you need an attorney. A lawyer will be able to best serve you in the creation or translation of any legal texts. While this distinction is the standard in most jurisdictions, check with your local state bar to find out what is allowed in your area.
Find out if your lawyer is licensed
Any time that you need legal guidance is an important time in your life. There are ways to be certain that you are not hiring a fake lawyer or attorney.
- Read law firm reviews from BBB.
- Check out the lawyer's website, which should have their status listed.
- Read reviews about the lawyer and ask others who have used their services about their experiences.
- Check your local state bar for their profile. Compare their name to the address and phone number listed.
- Contact your local Chamber of Commerce. Although it is not a requirement, many lawyers will register with the Chamber of Commerce.
- Contact the law school the lawyer attended to verify their degree.
Not only will verifying if the lawyer you are considering is legally allowed to practice law ease your mind, it can also bring up any disciplinary actions the lawyer may not have informed you about previously. Doing research will also help you decide if you should hire an attorney or a lawyer.
How to find an attorney's bar number
An attorney's bar number is the number assigned to them after successfully passing the bar exam. The bar number is a way the Association keeps track of each individual attorney's activity. This number is also a quick way to determine if the attorney you are interested in hiring is legitimate and allowed to legally practice in a court of law, as well as lists any charges and subsequent disciplinary actions that may have been brought against them. To find the number:
- Search your local state bar association's website. Every site should have a directory of attorneys near you.
- Call the local association and ask for the number as well as any information they may have on that individual attorney.
After you have figured out how to find an attorney's bar number, you may still feel unsure about hiring them. There are other ways to determine if they are the right attorney for you. Read BBB law firm reviews and ask for references from other clients.
