Rob Depietro was contracted to do home renovations at the home of my mother, ****** ***** ****, **** ******* ******* ******* ** ******  Work began on ***/23 after we paid the 50% deposit of $7492.68 on my credit card. Rob completed the demolition portion of the project and did secure some of the needed materials for project completion, however he did not complete most of the work. He also did not provide many of the correct materials, including hardwood, and the installation work he did do (framing, hanging drywall, mudding drywall) was done incorrectly, necessitating removal by another contractor. Rob also represented himself as a licensed contractor in the city of Auburn, AL, however I have since confirmed that he falsely represented his license status. On *** *** 2023, we terminated the contract per the service agreement terms. We agreed to pay for services correctly rendered at that point, along with any useable materials he had on site. He conceded he could not do the job as he agreed to and he agreed to refund the monies owed back to us. As of today, *** *** 2023, no refund has been received no has any evidence been sent to show a transaction even occurred.

She agreed when we could go not to publicly harass me or slander me also this is all false my contract states that I do not have to give a refund she signed and signature and initialed next to no refunds will be issued on my contract however in good faith I am issuing her a refund which you'll see in the screenshots however the bank has a hold on it we have been in contact the work was done correctly however there was a contractor that was trying to get the job that I already had and would criticize my work whether it was done correctly or not feeling her head up with lies about what was really going on in an effort to win over the job which he did end up getting he was the electrician and the plumber and ended up talking her into hiring him to do the work I was already doing but I have pictures and start to finish before and after of all the work I was doing I got a bachelor's degree in building construction the work I was doing was done correctly the framing was done correctly the drywall that she said was done incorrectly was because she believed that were the outlets and the light switch covers go the holes were a little bit too big which anybody knows that does drywall knows that you are supposed to mud tape around any outlet cover or light switch or any place that there's going to be some type of fixture but the other contractor was stealing her head with your supposed to cut direct to size when sometimes it's just not a possibility especially when working alone which I was and she knew that ahead of time there was no deadline however her mother was living with her which is whose house we were doing and she got annoyed with her mother living with her and all the sudden out of nowhere came up with a deadline that wasn't possible knowing that I was a one man crew in doing all the work myself and she came out with a deadline that just wasn't possible for anybody to do we're a week before she told me in person I am not worried about your timeline you've got plenty of time to do what you're doing and then a week later after the plumber got in her head and started criticizing in an effort to win over the job she completely turned on me I have a license I have insurance so I don't understand where she's getting that and I have proof of all this I have documentation of all this I have documentation of the entire job I have pictures of the entire job so if there's any information that is needed please feel free to reach out to me because I keep a meticulously detailed report of every job and my business entirely now if you would like a copy of the contract that says no refunds will be given especially when the money that was given was only for material I demoed the entire house from front to back kitchen bedrooms floors walls and put up drywall built framing works for over a month and the only money I received was material money now the flooring company sent over the wrong flooring which she was aware of when it got delivered the flooring got sent back and that is the money that she is waiting on right now which the bank has a hold of it it is out of my control I've already issued the refund I've already canceled the invoice I've done everything how I'm supposed to do it I would greatly appreciate to not have a negative Mark I'm five star business I work very hard to take care of the people I service and I've worked very hard to build and maintain a five-star rated company

      Complaint: ********

I am rejecting this response because it has been 3 weeks since we requested a refund and still no refund has been received or even showing pending on my card. I checked with my bank and they said they have no record of a pending refund coming from your bank and that it would be unusual for a sending bank to put a hold on a refund issued.  I have requested that Rob contact his bank with me on the call so I can better understand the problem.  If I can be provided confirmation from his bank that a refund is coming to me, then I am willing to accept his response but since I do not have that, I have no choice but to escalate. It has been 3 weeks now without resolution and the details that we have been provided simply don't make sense with what I can and can't validate.

      Sincerely,

      ***** *******
