      April 2023 Discussed over the phone with sales person about a 2023 Dodge Ram **** Big Horn, was approved over the phone with $300 down payment. Sales agent stated the vehicle was fully loaded. Stated they were giving us a good deal on this vehicle and he was not making any commission. We went to pick the truck up and did not have time to read over anything due to being late getting our child off the bus. We ended up with the truck being around $95,000 with interest and it is not fully loaded and it wasnt mentioned till after the papers were signed. We called back to return the truck and they stated we can not return it, once we drove off its now ours. Called around to sale the truck to other car lots and they all state the truck was only valued at $40,000 and we would have to pay all remaining on it which would be in the 20's without interest. We called the finance company ***************** and they state we can return the truck to the lot we bought it from ( again no returns) Chrysler Capital is not willing to work with us nor is the car lot listed. This is a $1200 a month payment. We have called trying to get them to come get the truck and it's still here in our yard so we decided not to make any payments and it's now 3 payments behind so once it gets repoed they will still charge us the remaining once auctioned and this has already ruined our credit. Dothan should take this truck back and repay the finance company. This truck is not worth $95,000 Dothan Chrysler Dodge Jeep Ram in Dothan is a ***** company and they new we were in a hurry and we were stupid for doing that deal but no one said a thing instead they kept our thoughts somewhere else by trying to small talk us while paper signing (mainly the sales guy) We have asked Chrysler and Dothan car lot to speak with someone higher and no one has returned our calls. This has been several times. We are expecting it to be repoed anytime now, we can keep the truck if the company will lower the interest and knock off the 3 past payments and start over. It's the least they could do for lying about the truck. Sales agents don't give a hoot as long as they can take your hard earned money and they make their profit. Work it out somehow with us:*We do not want this on our credit once given back, and do not want to be reliable for remaining once sold at a auction *Company can try to refinance for a better rate and start over if we kept the truck *Knock off the behind payments and start over *Take it back and remove it all from our record like it never happened(Chrysler Capital stated that can be done)

      Good morning.  I have reviewed the customer's statement, spoke tow both managers involved at my store and the salesman,  and below is my response.  

      My salesman does recall them calling seeking to get approval for a truck.  He initially called in looking at a used 2021 Ram 1500.  We took their information over the phone and submitted for approval from finance sources. We tried getting it approved on that vehicle, but the banks would not approve and we got finance turn downs. The manager suggested to ***** to ask the customer if he would buy a new 2023 Ram Big Horn if we could get that approved because of rebates and dealer discounts make the deal more attractable to the bank.   Doing this, we got a conditional approval from Chrysler Capital and multiple turndowns as well due to their credit and the bank's buying limitations.  We do not loan money, so we send the credit information and the banks make credit decisions that we pass along to the customers.  The sales manager then communicated with the salesman that he had worked out a great deal for the customer on the new Big Horn to be able to get the truck.  The **** on the truck was $56,245.  The customer put $300 down, and financed only $52,538 which included $3704.66 in taxes and fees so essentially paid $48,833.34 for the truck which was $7411.66 under list price which is a great deal.  However, the credit file and scores were low so their approved contract rate from Chrysler Capital was *****% which made their payment $1199.99 per month.  We cannot control customer's credit scores.  The banks set rates based on credit scores and we charge the customer based on those scores and rates.  Knowing this information, the customer came to the dealership, inspected and test drove the vehicle, then proceeded to do their paperwork in the finance office with the Business Manager, ************************* who goes over all the legal documents and disclosures.  In *******, the Retail Installment Contract clearly states in bold letters "NO COOLING OFF PERIOD. State law does not provide for a "cooling off" or cancellation period for this sale."   Neither of my managers recall any conversations with ************** trying to trade out or getting a different vehicle, and I certainly have never had a voicemail or message to call him myself.  Obviously when a loan is three months in default, it is difficult to trade with a customer but we are willing to try if the customer wants us to try to help him.  The deal cannot be rescinded and the vehicle is titled and owned by Mr. and *************** by their contractual agreement and signing to purchase the truck.  If they trade or pay off the loan, they don't owe all the interest of $37,461.25.  It's a simple interest loan and he financed approximately $52500.   As of today, his actual payoff including those fees and late charges is $55,253.11 plus $27.263 per diem.   If he would like to try to trade the truck before it gets repossessed and affects his credit, have him reach out to Bill *** who is the General Sales Manager at the store and we will do our best.  I regret to say we cannot just "knock off the behind payments and start over" because we do not hold the lien and the payments are not owed to us.  We will be happy to try to trade and/or refinance, but we have to have the customer's approval to initiate financial transactions with their credit due to regulations.  Thank you and have a great day.

      I am rejecting this response because:

      I have called and both times was told no cant bring back and was told to call back for the owner, no one has tryed to reach out. I have also asked Chrysler Capital to have a Manger call me and not received a call back. I am the one who has been reaching out since the day after we bought it. I did not go any further to test drive than that convenience store that your salesman said to stop at for gas. I did not inspect the truck, I only let someone download the app and I said it does not look fully loaded like he stated and the lady stated he didn't know what he was talking about. Then he came back out there started talking to us randomly to get our attention off the truck, my wife was trying to hurry us and checking time due to our child riding the bus. We did not go over paperwork, we rushed through signing (again due to our son.) Which we kept saying to them. My wife did notice after we signed, the interest rate. We did ask the salesman what the rate was a few times before hand and he would not say. He just kept saying we got a really good deal. Now tell me how is thats a good deal when the truck is valued at $40,000 we found that out the very next day. You state what we are paying for it, yes, but you act as if someone can fork out that kind of money up front and not worry about interest. It does not work that way for alot of people. Your salesman also stated we could trade in one or the other of the vehicles, we had already and then he calls back stating he can't on the truck we already had being it would have made us way over then he stated for us to drive the car there and we did, he never even looked at it just stated we couldn't trade it either and then we felt pushed to still buy the Dodge, we were asking questions and he would change the subject while signing the very first paper. He wanted to talk about how pretty my wife's eyes were. So yea you have yourself a pretty good salesman I'd say, to throw people off the subject. 

      As for **************** we have been the ones making the effort to call them everytime and they are the only ones trying to work with us before this conversation. They did state everytime we called that your company could have took the truck back when we asked them to. We are working with them and if it gets repoed then it just does. Still haven't spoken to a manager.

      Our credit is worse off now anyways so you are saying you can try to refinance which we already know won't happen due to credit not being good enough and you know that also, and trading in won't happen either because we have already tried with other companies and they all state the value of the truck is not worth it and we would be way over on trade in so no one would do it. The offers for companies to buy outright was way less than we owe so yes we got ripped off from the start and now your offering this while knowing we are stuck and won't get approved.
