      failed to tell me about black mold all through said property all the windows was painted shut when signing lease making false allegations about blinds that was already tore up and grass being cut saying they had to clean the place which is false.the company took my money and now saying i owe them and put it on my credit.

      **************** did not place any work orders for mold or issues with windows.  All units are inspected prior to rental and accepted in current condition.  Any time we would go to her house to knock on the door, we were not allowed to enter.  Moisture from the windows does not indicate mold "throughout" the home - it just indicates that the windows sweat.

      Regarding close out charges, as indicated on the tenant ledger, the bulk of the charges are for unpaid rent and late charges.  There was a charge for landscaping which is indicated by the pictures.  We are willing to give a credit for the blinds as there was obviously some sweating on the windows; however, that would still leave her with a legal and valid balance of $10,185.00.  Even if she claims that she left on a certain date, she did not turn in keys nor notify the office which then led to lock changes and grass issues.  Her lease spells out the responsibility of the tenant regarding notice as well as maintaining condition of the premises.

      I am rejecting this response because: I turned in my keys I gave them to the African American lady that sat at that desk when you walk in she said that she will log it if I would have known she wasnt I would have gotten proof that I turned them keys in they never did a walk through with me they gave me the keys and sent me over there by this time I had gave my money Caucasian lady  that sat on the side desk when you walk in told me that it was ************************************************************************ late fee saying that I still owed it 1250 it was ***** instead of ****************************************************** late fees which was over 250,I told ******** that someone came and cut those bushes down. She told me that it mustve been the people that was looking at the house or own the house  and she had people coming and taking pictures of the house inside and out. I will text her and she wouldnt respond. She will call me on the phone , I guess she knew if she text me back that would leave evidence of the stuff that she did not  truthful  and not being authentic about . Had I known that it was going to go this way I wouldve recorded every encounter and every phone call that I had with her company  and herself, but she still took my money, knowing that this house was full of mold and it wasnt  due to the windows just Sweating I really dont understand and see how this company is still in business

      There is no confusion about what is due as there is a lease agreement in place and there is a ledger that is posted to the tenant portal.  All tenants have access to their portal where they can monitor their charges and put in workorders for their property.  The portal is also where they put in move out requests so it is documented.  Whether the lease has expired or not, it is a requirement for a 30-day written notice to be turned in so that we know when tenant is leaving.  If that does not happen, we have no way of knowing when the tenant left and the law limits us to enter unless we know for certain that tenant has vacated the premises.  If we are not notified, the property sits vacant until we can legally enter and prepare the property for the next tenant.  If no notice is given, the tenant would be responsible for that time period.

      Company had falsify info of paperwork a few times, also lied to rental assistance, also decided to hike up the rent after the city was called to come to property, also has not returned my deposit after 60 days,a letter was finally sent and stated many issues which is also false, I have proof or pictures and videos, I had many issues including mold on shoes which was never addressed, I'm asking for help before I sue

      Business Response /* (1000, 5, 2022/01/20) */ Our company denies any wrongdoing in this matter. Regarding rental increase upon her lease expiration - ALL homes, I repeat ALL are getting increases due to low inventory and high demand of homes. This is also the expectation of the owner of the home. Ms. ***** was notified ahead of her lease expiration as the lease goes into automatic month to month rent - which is PER her lease agreement. Rent goes up 25% if your initial lease has expired. This, of course, was signed and acknowledged by Ms. *****. We advised her that she would need to issue a written 30 day notice PER her lease agreement and she refused and said she did not have to. She did indicate that she did not want to renew but never issued that notice nor had a walk through with our staff nor did she return keys. We attempted on multiple occasions to reach her without success. We still had organizations calling on her behalf in the following months - once on 11/22 and then again on 12/2/21. We received a certified letter from ****** ***** just before Christmas indicating that she moved out and she gave us her new address. We then went to check the house. There was chairs, a large mirror, trash and other items that had to be removed from the home. We received a second letter from Ms. ***** on 1/7/22 indicating same mailing address and making further demands. We sent her a disposition letter with her charges from Nov and Dec with late fees as she had not returned possession, in addition to the money we paid for trash out, housekeeping and lock change as would be anticipated on any SKIP. Her balance currently is $734.86 after her deposit was credited. Note: She was only charged her normal rent amount and not the month to month rate that would be due, in addition, we prorated Dec. It is not enough to indicate you would like to leave the home, you have to return possession of the unit. We are glad to compromise as we would with tenants who communicate with us or we can file a counter if it goes further. I turned in keys Oct 31, I went August about renew the lease she stated she would go up 50, which means I'll pay 1000 instead of 950, okay that is fine cuz I was already paying 1000 already to stay ahead, month and sum ova I had issues with air, it was advisory months, i have a disable son, it took month and wk to fix the air, I call the city, she had to make repairs on home that's when she want the highest rent due to me calling city n her having to make repairs. she stayed that out of mouth, I have sent and stated out of mouth multiple times I will not stay I will move cuz I'm a single mom and can't pay 1025-1075 for rent. she still owes me money from me over paying monthly, also I'm sending ova pictures and videos, thank u kindly Business Response /* (4000, 9, 2022/01/27) */ Not certain I understand everything in her statement but our company does not falsify paperwork. The tenant herself sent the certified letters which we have in our possession. The phone calls from outside agencies can be verified. In light; however, of her being a single mother of a disabled child, we are willing to keep her out of collection status to protect her future rental prospects. We will not return any deposit as she did not go through the proper procedures to leave the unit. This is a valid compromise, otherwise our company would prevail based on our documentation, along with tenant's own documentation.
