***************** is a photographer. He took great business photographs for me in February 2023. I paid him about $700 for that service. We then agreed he would be the videographer for my professional videos; he promised the highest quality videos that looked expensive bc I was marketing to law firms. I paid him $4,872.93. We shot videos for one afternoon after his wife did my hair and makeup. It did not go well for a variety of reasons, we all agreed. The plan was for us to reshoot later in the summer. I changed my mind and decided I did not want to work with him any longer - he wasn't responsive to communications, the "set" he built was shabby furniture from his house, the air conditioner had to be off during shoots bc he had the wrong microphones, it was a mess. I told him I wanted to pay him fairly for the work he had done so far, to get the videos we made, and to have a refund on the remaining amount. I explained that we had agreed that a high-quality video was worth $4872 and what was made was not high-quality, so the value of services performed so far was less than the full amount. I suggested that he keep $1500 for the day's work, send me the videos, and refund the rest. He refuses. I don't have the videos we made and he has kept the full amount. Honestly, I would split the difference to have some money back - i.e., he refunds $2,400 and sends me what we made. I fear he has spent the money ... But he should at least send me the videos. I have nothing. Please help?
