ACE Recycling has had to block ***** and PCPM from our social media due to his harassment. This harassment is in addition to him using abusive and unprofessional language when the incident occurred and after that. He specifically threatened, "I will ruin your reputation," which I presume is why he has moved to create this complaint. ACE Recycling sent a pallet of hard drives to PCPM. That pallet left our warehouse in good condition. It was transferred from one truck to another in the week and a half it took to arrive in ************ from our location in *******. When the pallet arrived, it was not in the same condition as when it left our warehouse. It is ACE Recycling's understanding that the load included other pallets in disarray.
Per our Shipping Contract, the buyer assumes all risk of loss, as is standard practice in our industry. ACE Recycling filed a claim on behalf of PCPM that the shipping company paid out. PCPM accepted this payment. All hard drives are erased in accordance with NIST guidelines and in working condition. The hard drives that were sent to PCMP were not "failed" or "defective," although ACE Recycling is unclear what that means in this context. Considering the condition when they arrived in ************, they were likely damaged in transport.
This customer used abusive, unprofessional language and has continuously harassed ACE Recycling. ACE Recycling is not the only company that PCPM has done this to, as evidenced by the publicly available reviews on the company's ****** profile. We would also like to point out that the *** (Uniform Commercial Code) is several Federal Acts that *** or *** not have been adopted by States as law. They are not, in and of themselves, law. The adoption of the *** varies from state to state. Even states that have adopted the identical language of the *** have different interpretations of that language. ACE Recycling is well within ** law.
