***** **** the owner and licensed contractor with Arizona Unique Renovations bid is a fence project priced at $17,000. We verbally agreed with photos and texts to the fencing design. Issues came up during the project and we were told they would be addressed. Once payment was complete, we were never followed up on, no invoice, no receipts, no communication. 35 texts were sent with all of the fencing concerns with no response. We found out the entire fence was put in and installed by an unlicensed contractor. We had the fence evaluated by 2 fence contractors and there are major structural defects in which all of the posts have only been set in 6-8 inches and secured into an adobe wall. The fence height is illegal for the city of Tucson and no permit was obtained. The size of the supporting fence posts are the wrong gauge to withstand weather and aging of the fence and it’s integrity. Some mystery chemical was sprayed in the fence and it’s color, texture and coverage is incorrect for aged metal fencing. There are no finished pieces, caps etc. The posts were painted a “rust” color and these posts were not sanded and just painted over blue fence posts and will chip and not stick. The framing of all the fencing was notdone as to what was agreed to so the tops of all the fencing is exposed sharp metal. This contractor also referred us to an adobe contractor, who also ended up being unlicensed and he stole a $1500 deposit and we have never heard from the adobe contractor again. This work had been determined to be sub standard, not done in a workman like manner to the standard on the community and we have been taken for $17,000 plus $1,500 trusting in this contractor and his license. We made 3 payment installments, and the last check he cashed had no name or signature on the check and it is being investigated for bank fraud. Our fence is structurally unsound and illegal and we are in need of a full fence repair possibly only able to maybe salvage the panels used. Pls help.

      Complaint 17496366                                                                                     July 11, 2022

Mr. & Mrs. ********** want me to make them an affordable package to remove an adobe brick wall, and replace it with a metal sheeting fence. Part of their house had existing wood fence that they want me to replace it with metal sheets. When I asked them what king of sheet metal they want, they could not tell me what kind of the metal sheet they wanted on the fence. I went on line and grab a picture of a sliding metal fence door that that was framed around the door as part of the sliding door structure with corrugated metal sheets. The picture sent to them was meant to show them what was a corrugated sheet metal and how it looks. They agreed that we were going to remove the wood fence and replace it using the existing metal frame, which it was paint it blue. They also agreed on the color for the paint that was going to go on the existing metal posts. After removing the adobe wall, we noticed that the neighbor’s property was lower. I recommended to leave the footing of the adobe wall to prevent dirt washing away to their neighbor property, which they both agreed. On the back part of the house where the adobe wall was removed, Mr. & Mrs.  wanted privacy to their back yard because their neighbor had a security camera pointing it at them. They wanted to extend the height of the fence to block the view from the neighbor’s camera otherwise we would it leave it at 6 feet.

When I received the last payment, they had some concern about the look of the fence, they wanted a rust look on the fence. I told them about two processes of rusting the metal fence, one was using acid wash to speed up the rusting process, but it would reduce the life of the fence. The second option was a slower process but it would extend the life of the fence. They wanted to know how fast it would change and I told them that the fence would start changing as soon it get wet. They decided to leave it alone and let it rust by itself. The mystery chemical spray that was sprayed that my customer is referring to, is nothing more than a degreaser to remove the oil from the metal sheeting that is put on by the manufacturer to prevent it from getting rust in a short period of time. By removing the oil, the fence starts rusting as soon is exposed to moisture and water.

Mr. ********** and me had a conversation about caps missing and about the rusting of the fence. I told him that I was going to put the caps and put some water on the fence so they can start seeing the fence rust faster, and told him that I was busy in another project that I’ll let him know when I was going to see them and go over their concerns. I continue receiving texts from Mrs. ********** about the concerns that I was talking to his husband. On June, 24 2022 I text Mr. ********** setting a day and time to see them and install the caps and to go over everything, I never got a confirmation or response.

We are working in resolving these complaints with the Arizona Registrar of Contractors and Mr. & Mrs Upspringer.

      Customer response

      07/12/2022

We don't need excuses nor reasons why the fencing project is substandard and not completed in a workmanlike manner standard to the industry. The structure and integrity of the fencing is now in question as evaluated by 2 separate licensed fencing contractors who both also have evaluated the workmanship, dressing and finish work of the project. There is also questions as to whether with the demolition of the part of the adobe wall that was attached to our home, that the structure of our home may have sustained damage.  From Thursday, June 9 - Wednesday, June 22 ***** was sent 60 texts/photos and was also requested to call either my husband or myself. There was no response during this time other than either nothing, ignoring the communication or excuses to push us off as the last payment had been made. The only response we finally received was a text to my phone on Friday, June 24 which was directed to my husband and not myself asking to now meet and go over the fence, which was the day ***** received the case against him from the ROC. A text asking to meet with just my husband is not a solution.  We have an investigator from the ROC coming to our home on Wednesday, July 20.

Please also note that during the fencing project we asked for an adobe contractor referral as our home needed adobe repair and sealing. ***** did not recommend using a large local adobe company such as Adobe Kings as they were not reliable, however he did remember working with a contractor who had a place in Marana where they made adobe bricks and he would try to remember his name. ***** amazingly ran into this contractor at the gas station and then handed us his business card and referred us to him for adobe work. ***** also asked us how much the large local adobe company quoted us as he did not know how much a project like ours would cost. We contacted this adobe contractor. We had him come out and evaluate our home and give us a quote when ***** was scheduled to be here, so they were here together. The quote the adobe contractor gave us was for the exact amount as what the large local adobe company quoted us. We negotiated a contract and work was supposed to begin within the week.  This adobe contractor stole our deposit and never completed any work. We found out this week that the adobe contractor is under investigation by the ROC for theft and fraud. The adobe contractor is now under investigation by the attorney general's office for possible felony violations.  It feels like we were a part of a scam or ring of deception that our family was dragged into by *****. It is concerning, distressing and extremely serious. We are now in communication to have a protective order placed on this adobe contractor for our family's safety. I have reached out to the Southern BBB by telephone yesterday to speak with someone about these new developments in regard to this case, however no one has returned my call.
