My husband and I ordered new flooring from Belmont Carpets and Wood Flooring. The total cost for the materials and installation, using one of their contractors was $22,151.64.We were asked to put down a deposit of $11,419.00 in early/mid November, which we did.We decided to find our own contractor after getting the ok from ***************************** (the sales rep we were working with). He said we it was no problem and we could work with whatever installer we chose. The problem is, the deposit not only covered the materials, but it also covered $686.48 towards their installers (which we never used), as well as some glue ($230 which we also never picked up because our installer didn't need). $686.48 plus the $230 for glue is $916.48.I spoke with ***** via texts (which I still have on my phone) on several occasions to find out where our refund was. He gave me several different excuses as to why we hadn't been refunded yet. First, it was that my contractor needed to pick up all the material first, and they would cut us a check at that time. Then it was that the invoice had to be closed out and a check would be mailed to us. Then, he said he didn't know why we hadn't received the refund check, but he would "look into it". Then it was that we would "hopefully get by the end of the month" which was the end of January. Now, he told me today that the company has gone under. I asked him who I can talk to about getting my money back and he said he could give me her name, but he refused to give me her number because she also owes him money and he doesn't want to make her mad.Her name is ************************************ had been in business for years and years, so I never thought we would have a problem like this. I don't know if I need to contact a lawyer, or what I have to do next.

We provided Belmont Carpets a down payment for Carpet for our home on October 15, 2023 in the amount of $2,593.00. Over the next two months we were not contacted. I reached out to them about every two weeks to see the status and each time there was a problem. I was told that the order missed the shipment dates and was in the next order. In November I was told that my order was part of three that were lost by **** Carpets and that it was being corrected. In early Dec (12/11/23) I was told that it was arriving the following week. When I called back I was told the carpet was the wrong type and that they wanted to cancel the order. I was satisfied with the cancellation and wanted to get my check back, I was told that only the Owner ***** could write a check and she was in ***** over Christmas caring for her mother. I called back the first week of January **** and told she was still gone. Because I paid with a check they could not give me repayment any other way. I was told to coordinate with *******. He had called me once or twice before to tell me about ***** and her not being at the office so I didn't come by and try to get a check. On Jan 10 I left a message for ******* stating I wanted my money back or the carpet to be ordered and got no callback. On Jan 16, 2023, I called ***************************** (original sales person) and he told me that they were going to settle debts but that the company was closing down. He said they had about another week in the facility but are not answering the phone. I can provide *****'s cell phone as it was provided on his business card if desired and the main line is not being answered. ***** would not give me contact info for ******************, ***** or her husband ****. I feel I am going to not be paid back and don't know what recourse I have. Any help would be appreciated.Note that the first check I gave them #**** was made out correctly. I delivered a second check #**** filled out properly.
