I was sold advertisement that with out any delivery of such. They sold me magazine advertisement and has completely ripped me off. I can not get a hold of any employee to talk about when the magazine is going to come out.Business response

********************************* has been in communication with our customer service department. He will be receiving magazines today with his ad clearly displayed. They will be in the markets in the next two weeks.
He has told us he is retracting his complaint which he now knows is in error. We expect that he will follow through with his promise as we will continue to promote his business.

I was reached out by one of their salesman and he sold me for sure. I was promised page 2 that was a big deal for me and why I got a bigger ad etc. They put my ad page 2 from the back of the magazine very ********** wasnt in the paperwork of course. The salesman said the ad would be running in August and it didnt start running until September. They said that the magazine rack would be right when you walk into Whole Foods and it was not. When I went to look at the rack they werent even in the rack and it wasnt at 2 other locations that were promised. This had been weeks after I thought they were in the racks. The purposed TV ad has not happened that was promised in august as well. I tried to get my money back and they refused even though I didnt want to continue services with them. I understand I signed a contract but what I was signing for I didnt receive. Im a new owner and I feel like I was taken advantage of. I havent had a single customer from this advertisement and while I know there is no guarantee of that and I spent $1600 for nothingBusiness response

The ad in the magazine was proofed and approved on 8/1/2023.
The ad that is currently in the magazine and on display in the markets is below.
The magazines were printed and shipped to the distributor.

We have been willing to work with this customer and have discounted the ad price to accommodate their unfounded concerns.
Each and every part of the advertising sales agreement is now and will continue to be fulfilled.
We will provide any documentation required to show compliance with this contract.

I wish it gave more characters options because I can't got into all of it, post pictures of prof etc. So I'll try my best. In November of 2021 ***** ****** owner of Choice Media Corp. in **, contacted me. Tells me he wants me & my *** business to be in his magazine. Comes w/ TV ad, ****** & ****** spots plus more. Says his "producer" will be at my house that afternoon to get my information. Producer ********* (who we will never see/hear from again) after he leaves. Offers me this grand & lucrative advertising deal. I tell him I have to think about it, ***** states he has another meeting tonight so it's now or never. Done so coercively & deceitfully w/ the info he did/did not share (things like the back of the contract that states this is a non-cancable" contract). The check is cashed & nothing for over a week. The next week I contact the owner who had called me. It first starts w/ me saying "wait you told me this but the contract says this". *** ***** tells me "yes" to "ignoring what it says in the contract & that it is what he says it is". This is in November. Release date I'm told by both men will be Jan. 1st. 2022, we're in mid Feb; magazine was never released. 2nd thing starts, contract says "payments due on day X". I contacted ***** (the owner in text) and again, "ignore it, it is what I said it would be". All the complaints against them on the BBB are exactly my story! Only mines WAY worse... Was never told anything about a new release date, TV dates, submission dates, nothing! Then when I try to get out I'm told "oh well", we don't care what you say. After talking to my lawyer & the disability Advocates turn out them ******* I was mentally disabled, coercion, misinformation & putting me under such duress with this ***** THE ********* It is illegal for me to enter into any such deal and they knew this! Their contract is no good! I have asked for my $ back & their illegal contract be thrown out. I haven't hear back from them. I will repost daily.Business response

Business Response /* (1000, 5, 2022/02/18) */ Thank you for the opportunity to respond to this customers concerns. ***** ********** entered into an advertising sales agreement in November of 2021. There has been some confusion about the process we go through from the very beginning. She is also completely misunderstanding our position on this advertising agreement. We as a company rely only on the written contract to guide our business decisions. That is made very clear in the contract. "Advertiser acknowledges that upon signing this agreement (1) He/She has read this agreement and has not relied upon any promise, statement and/or representation other than contained herein and hereby acknowledges receipt of a carbon copy of this agreement" She is also misinformed about the ownership of the company. We will work with *** ********** and give her an opportunity to pay as she sees the completion of the various parts of the agreement. We will send her printed magazine next week and when she realizes that this is all real then we will work towards a payment resolution. Consumer Response /* (3000, 7, 2022/02/18) */ (The consumer indicated he/she DID NOT accept the response from the business.) There is no confusion on my part. I know who the owner is, he addressed himself as the owner as well as it shows him as the owner. ****** the gentleman that signed me up did so with coercion, under extreme ******* ************** & false ************ THE WORST PART OF ****** Is I am legally disabled! Both the owner & ***** were aware of this, they were also aware I was under medication from ******** I had to have my husband explain the basic details. According to the law I was in no way LEGALLY able to enter into this contact. I wasn't even ***** the whole contract. So when I asked to have the contract void I was told no. I was given different information from 3 different people, (all backed up by emails/texts). AND the disability law firm & several legal codes (anyone can look up) will clearly show them not letting me out of this contract IS ******** I have been told so many different things from these people I am done. I CONTINUE to tell them this & they CONTINUE to tell me "they will be sending me a copy of my ad". They have said this since December! EVEN THOUGH I have told them every single time they have sent me a proof I ***** it. A two year old could have done it! But the FACT is my mental disability & state of mind prohibit me from entering said contract. Bottom line! This is a savings of $****. I emailed the V.P back, *** **** and told him I appreciated the offer but I do not accept it. After how poorly I've been treated, lied too, and did NOT approve the last ad they wanted to put in the magazine; I am just done. The "art department" came up with my "designed ad" that had information next to pictures of things that had NOTHING to do with said pictures!? I would never buy from a company who's own ad didn't make any sense. Further more if you read Miss *** ***** statement on 02/18 she states I would receive a copy of the magazine "next week" to "prove they are a real company and not a scam". Yet here we are, over a week later... no magazine was ever sent; Proving my point further. They have lost all my confidence and trust, there is no fixing this. And AGAIN, I am disabled, I was not legally able to enter into this contract. I want my money back and I want to try and forget about the emotional toll this has taken on me over the last 4 months. Since things continue to be the same with people telling me different things every other conversation I have reported them to ************, Report Fraud FTC, ********* and the State Attorney Generals Office. After reading all the legal actions taken against them, the reviews, I refuse to be another victim of Choice Media.
