Business Response /* (1000, 8, 2022/07/15) */ BBB CASE#: ******* To whom it may concern, Thank you for your email. Please note we are a business-to-business lead generation company. We process applications that are submitted to our network. We process such leads to the lenders who in turn reach out to the consumer, through the consumer's application. We have performed a thorough investigation and found that the consumer applied on our client/affiliate's website voluntarily providing their personal information and consent on various sites, multiple times, since February 2022. All applications and forms have consent language and disclosures in place to which the consumer fills out and agrees to be contacted by any marketing affiliates and/or third parties. As such,************** is not our client. Further, based on our research and internal review, we have found this individual to be a potential serial plaintiff who targets companies for unfounded claims or violations and utilizes these claims for nefarious purposes to generate complaints and or lawsuits. Additionally, the information a consumer posts in public areas, sites, or applications may be accessed, utilized, and stored by others around the world, including those in countries that might not have legislation that guarantees adequate protection of personal information as defined by your country of residence. While our Company takes measures to safeguard information from unauthorized access or inappropriate use, we do not control third parties or affiliates and we are not responsible for their use of the information a consumer provides. Accordingly, a consumer should not apply on these web forms, nor post sensitive information such as contact info or any other information, that he/or she does not want shared to any additional sites. We hope that this clears the matter and resolves any pending issues related to case #*******. Consumer Response /* (3000, 10, 2022/07/18) */ (The consumer indicated he/she DID NOT accept the response from the business.) I have never visited an website providing consent to Zero Parallel to sell or share my information, and the websites I have visited of this nature were in direct response to offers of cash, rewards, or prizes. Zero Parallel's response indicates they are hiring offshore affiliates and marketing partners to gather costumer data as "leads" and then reselling them. Zero Parallel holds themselves out as marketing experts, and as experts (and as they indicated in their response) know that offshore marketing partners openly violate US laws on behalf of and to the benefit of Zero Parallel. Please provide the legal name and address of these marketing partners, and any documentation showing the alleged consent for Zero Parallel and ******************* to contact me. Business Response /* (4000, 12, 2022/07/29) */ To Whom It May Concern: Thank you for your email regarding the Better Business Bureau ("BBB" or the "Bureau") complaint filed by************** (the "Complainant") and dated June 22, 2022, BBB Case No. *******. Zero Parallel's position remains as originally shared with the Bureau in our response dated July 18, 2022. That is, Zero Parallel has investigated********* allegations and concluded that there is no merit to his purported claims. As such, Zero Parallel does not believe there is a proper legal or factual basis to demand confidential proprietary information about its clients or third-party affiliates. In a good faith effort to respond to********* allegations, I wish to provide you with a summary of Zero Parallel's investigation into his allegations so you can understand our position. First and foremost, Zero Parallel is not the entity that reached out to ******. Zero Parallel does not service the consumer, nor initiates any contact with said consumer; it is a marketplace that assists those who are looking for loans and connects them with lenders. The application the consumer fills out is sent as a direct inquiry to the marketplace, which is why the consumer is then contacted by lenders in response to his/or her application. In fact, ****** had previously submitted such loan inquiries several times with the same name, however, with different personal identifiable information such as different Social Security and different phone numbers. As explained in our July 18th response, Zero Parallel's Affiliates secured prior express written consent to contact the *************************** phone numbers from various applications from February 2, 2022 at 9:37:54 PST (the first date ****** submitted the application through the last date he submitted an application) on June 28, 2022 at 20:07:13 PST. This information was submitted to one of Zero Parallel's third-party affiliates. The existence of such prior express written consent negates any claim that Zero Parallel violated the ****** cellphone provision with regard to any subsequent contact made to the listed phone numbers. Based on our investigation, the lead was submitted to Zero Parallel's third-party affiliate containing the phone number with a name that matches the Complainant's name. Furthermore, Zero Parallel's investigation reveals that ****** has a pattern of filing **** claims under suspiciously similar circumstances where his alleged phone number was submitted to companies under the same name. See, e.g., ****** v. *****************, No. ************* ***********; ****** v.**************, No. ************************); ****** v. ********************************, No. ************************** Mr. ****** has further documented his litigious efforts through the media and************* ******* videos instructing others on filing **** claims. See, e.g.,**************, How a Texas Man Made Over $100K Suing Telemarketers Over Robocalls, *************. (March 23, 2022), ******************************************************************************************************************************************************************************************** Tips For Anyone Looking To Do The Same, ABC ******* (Apr. 7, 2022), ************************************************************************************************************************************************** These set of facts illustrate that ****** is not in need of a loan or any legitimate service as he continues to fill out applications with fake social security numbers (SSNs not included for the protection of the consumer and potential consumer whose identity he may be utilizing to apply on various applications) and telephone numbers. His intentions are conducted in bad faith and he is brazenly fishing for ways to file frivolous lawsuits and complaints. Based on our investigation,********* litigious reputation, and his tendency to alter personal information upon his application submissions, Zero Parallel believes that his complaint to the Bureau lacks merit. Thank you for your attention to this matter. We hope this resolves any issues related to BBB Case No. *******. Consumer Response /* (4200, 14, 2022/08/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) Zero Parallel has avoided addressing the issue, but instead tried to victim blame based on my history of enforcing my rights through the court. The absurdity of their response is compounded by their claim of being experts in the lead generation industry, while using shady and anonymous affiliates. They have still yet to produce any of the alleged consent or identity of these mysterious affiliates. ZP has a history of this kind of unethical and illegal behavior, as evidenced by a quick google search to see government agencies have already cited ZP for their disregard for legal and ethical standards. ******************************************************************************************************************************************************* It's clear a resolution is unreachable, as ZP takes the perspective that consumers should be passive victim to endless harassment by lead generators and marketers who are too lazy to conduct honest busy.
