      As part of the move-in process at 75 ********, a $500 security deposit was provided on April 12, 2023. Upon move-out on August 4, 2023, three bags of trash were left behind. On August 9, these bags of trash were assigned a damage of $30 each to be split between four roommates (i.e. $22.50 per person). This is a "money grab" and a prime example of a predatory business practice that aims to take advantage of student tenants. There is simply no reason that it would cost $30 to move a bag of trash ten steps to the garbage room, especially considering that two of the bags were already collected. I would like the charge adjusted to a number that actually reflects the cost of damages; $5 per bag sounds reasonable.

      Hello,

      We have provided responses to ***** via email. The $30 per bag of trash aligns with the university residential damage charges listed on their website. This service fee accounts for labor for our team to collect and dispose of the trash properly that is left in the unit. In the lease agreement it states the following under deposit and damages. Residents are responsible, both individually and collectively, for all damages and defacement of their room and furnishings and or any damage to public areas. In the move out inspection report that was attached it shows pictures of the trash in the common areas which is a shared space in the unit. This results in a split charge among all occupants of the unit. We suggested that the resident work with the other occupants to provide written responsibility for the trash left behind in order to make any corrections to damage charges.

      I am rejecting this response because:

      I am not disputing any of the facts that you have repeated: trash was left behind in the unit, I should have to pay for my portion of it, and that the damage charge was listed at $30 per bag of trash on the website. What I am claiming is that $30 per bag of trash is price gouging, and this point has been skirted in all responses I have received from you.

      Why not charge $1000 per bag of trash? Surely a reasonable person would agree that $1000 does not reflect the actual cost of removing a bag of trash; neither does $30. As stated in my initial correspondence, I would like the damage fee to be changed to an amount that reflects the damage done.

      Thank you for your response. As stated in the signed lease agreement under move out instructions, Belongings left behind will be recycled (when possible) or thrown away, and you will be subject to a removal fee. The move out instructions list bullet points that state emptying trash and compost bins using appropriate trash chutes in the trash room, hallways clear of trash and personal belongings and all trash removed from unit and hallways. As communicated previously this is a split charge among all occupants of the unit as stated in the signed lease agreement and we would need written communication from one of the roommates in order redistribute the charges. The charge is a service removal fee that includes time collecting the trash throughout the unit and disposing of it properly as stated in the signed lease agreement.

      As I have stated before, I take issue with the amount that I am being charged because it is unreasonable. You can refund all of the roommates if you can't do it for just me.
