In July 2022, I purchased the tire and wheel protection plan from Santa Monica BMW and paid a total of $4246. However, due to unforeseen circumstances, I had to cancel the plan on 8/14/2023. *** North America promptly issued a refund check of $2818.59, which was duly cashed by Santa Monica BMW in August 2023. To my dismay, I have only received a partial refund of $1181.82, leaving a significant amount of $1636.77 still pending. I have communicated with their finance department, including individuals named *** and *****, but regrettably, my concerns have not been addressed satisfactorily. Despite my repeated attempts to resolve this matter, I am still left with an outstanding refund.Initial Complaint

Purchase a 2019 BMW ***************** from dealership on September 2, 2022 $40,588.50. Website photos showed no cosmetic damage to car of any sort to the car. Dealer provided me with a True 360 Certificate that stated the car had "Very Minor Cosmetic Repairs", that the car had been in a minor accident and that repairs were done on the front and rear of the car. The Certificate states the "Cosmetic Body Score of 98" meaning the repairs were within 2% of being prefect. I reached out to True 360 and they have no record of the Certificate. I purchased the car assuming it to be almost perfect and assumed an authorized BMW dealership would be forth right. I had the car delivered to my residence ***************** Upon receiving the car I was shocked to see all the damage on the car. I have an estimate from two body shops one for the amount of $4,360.14 and the other for $2,667.91 the lesser of the two does not include a new rocker panel rather just painting it nor does it include repairing the edges of the two drivers side doors. The damage included: Re-aligning the front bumper/grill to the hood to fix the uneven gap, repainting the hood to fix all the scratches and blemishes, repair the front passenger finder where the hood hit the fender, repair damage to passenger front door, replace driver side rocker panel, repair damage to top of tailgate from something rubbing against it, repair the paint on the edge of the driver side doors and remove three dents two of which are on the gas cap cover and other by the driver side back window. There was no mention that the second key was missing with a cost of $434.84 to replace it. I have photos that were taken by the driver of the trucking company that shows all of the above listed damage. Bottom line I was taken advantage of because the car was being sent out of state!!!Initial Complaint

I sold my car to this dealership and they wrote me a check that bounced back for a large sum of money. When I contacted the dealership they simply routed me through departments and wouldn't let me speak to anyone in charge. This is a potential criminal act of check fraud and has not been resolved.Business response
