I purchased a suit from this retailer, assisted by *****, on 8/9/23 with a $250 non-refundable deposit. I picked up the suit on 8/17/23. I wasn't measured before the suit was ordered for me, and I wasn't offered the opportunity to try it on in-store when it arrived. Later, after trying it on at home, I found the suit too large and immediately contacted *****, who assured me it was the right size and dismissed all of my concerns. He also assured me that tailoring would cost under $100, but all quotes from the tailors on their recommended list exceeded $250-300. A tailor also confirmed the suit was several sizes too big, would be costly to alter, and said even with extensive reworking the suit would not fit well due to the disparate size. I contacted ****, the business owner, to express my concerns, but he became confrontational and falsely claimed I was in a rush when picking up the suit. He also confronted ***** rudely while on the phone with me. **** then asked me to visit the store to resolve the issue. During my visit to the store, **** informed me that had already ordered the suit in a smaller size, but I asked instead to return the suit, as I was no longer comfortable working with them due to mistrust and mistreatment, and because ****'s demeanor was upsetting. **** refused aggressively, waving his hands in the air and yelling that was "not going to happen under any circumstances!" I left with the suit. I only discovered a small, handwritten "all sales final" note on the receipt, written after my final payment was made. No policy about returns was posted online, in-store, or on the merchandise. I was not informed that this would be a final sale even when I made the deposit. Therefore, according to California Civil Code section ****, I believe I am *********** a refund. I am not asking for a full refund, as I know the $250 deposit portion was non-refundable. I am only asking for the remaining $514.70 be returned to me in exchange for the unworn, unaltered suit.Business response
