BLUF: Owner did not complete work that was agreed to. Owner stated that a refund of 1/2 ($1081.25) would be provided the week of 7/17/2023. Contacted owner 7/24 and 7/27 reminding him about his commitment. He responded 7/27/2023 that he would be bringing the check by 7/28 around 12-1pm. Owner is yet to deliver refund as stated. Details: Setup a contract (5/1/2023) with Triton Brite Exterior Solutions LLC for paver repair, cleaning, sanding and sealing. Initial deposit was given to the owner ($2162.50 on 5/3/2023). The Paver repair work work was completed (06/11/2023) and pavers cleaned (06/13/2023). Devin scheduled the date to complete the sand and seal portion of the work. (06/14/2023) - pavers cleaned Devin then stopped by to sand and seal. (6/15/2023) - attempted to sand small area and left. work not completed. - Devin asks to reschedule Devin contacts us (7/8/2023) stating he will be at our house to complete work (7/13/2023) - he claimed to have lost contact info for neighbor, provided her phone number. I contacted Devin (7/12/2023) asking what time I should expect him on 7/13. - Devin tells he we was going to let me know on the morning of 7/13 he is not coming After a long series and a phone call with Devin's wife (7/12) - Devin states "Your refund will be cut in half since Work has already been done. For the work that my guys did and I already cleaned the driveway, which was five hours of my time, and the whole back area included in that time. I’ll have your refund to you next week." I contacted Devin 7/24 and 7/27 as the week timeline had expired. Devin responded "I will bring a check by tomorrow. Around 12-1pm" Later that day received an email from Devin stating that the refund is non-refundable. The contract, emails, and text messages do not state that the refund is non refundable. Devin stated the refund would be 1/2 and when the refund would be provided. see supporting documentation
