The purpose of this complaint is to express concerns about the quality of service provided by G. Poxy who provides epoxy floor coverings for pools and garages. In short, he installed an epoxy floor for my pool deck in September 2021. Approximately 18 months later, the epoxy covering began to peel and deteriorate. I called him in April 2023, and he sent out a representative to re-seal the pool deck in May 2023. Less than a year later, the pool deck once again began to show continued signs of peeling and deterioration. I made repeated calls to him on February 13, 2024, March 13, 2024, and April 2, 2024 where he provided continued assurance that he would come out to inspect the issues. That said, he stopped communication in May 2024, and it is clear that he is not standing by his assurance and guarantee that the epoxy covering should last last 10 years. I paid over $4,000 for an epoxy pool deck that is continuing to erode because of either inferior product or defective installation. In either case, and because he has refused to support his guarantee on his product and service, I am issuing this complaint.

I advised the customer that the coating should last ******************************************************************* patios as the weather and other factors come into play (unlike garage floors). There is no guarantee and no paperwork was ever given to say such a thing. He's a nice man but he is is now upset that I will not come and give him a quote for a new layer of coating. We are sorry he is unhappy but there is nothing more I can do as I am having severe health issues.

      Complaint: 21954597

I am rejecting his response based on the following:

I will preface my response first by stating (1) that I am not now or have I ever been previous to this complaint, angry, and (2) that he, over the course of 5 months, never stated at any time to me in any of our correspondence that his continued delays in coming to my house to repair the workmanship issues were in any way related to a health issue.
With regard to his reference that no written guarantee one the 10 year warranty was provided, I agree with that statement, but he and his workers stated verbally to me that the product and installation is expected to last at least 10 years and there was never any conditional premise to that verbal guarantee regarding weather.

Irrespective of the written guarantee, and with regard to his last statement that there is nothing more he can do, that is simply untrue, and reflects his unwillingness to correct known defects which began less than 18 months after initial application, and then again reoccured, less than 11 months after another coating was applied.

In short, I continue to seek resolution of the continued degradation of the epoxy floor covering that he applied in 2021, either through repairs to those areas currently affected or complete resealing of the pool deck.  I am willing to assume some the associated costs for the repairs, but I am not willing to ignore his failure to correct the issues.  If he is willing to assess and repair the degradation issues, then I will work with him on my share of the costs, but if he continues to ignore the repairs and state theres nothing more he can do (by the way, he has a son and other workers that are employed by him that can do the repairs independent of his health issues), then I will be escalating my complaint the Florida State Attorney General for resolution.

      Sincerely,
