      June 29th 2024- am umbrella company Apex shows and events hosted Splash fest in downtown Florida. It’s is 97 degrees with a heat index of 118. This event is for children primarily so there are parents and grandparents there to accompany children- paying anywhere from 5-15 per person to go in the event. Some people don’t have chairs and tents- a lot of people are visiting the city on vacation. There is 2 tents with mist water and fans at the event- a bunch of elderly grandparents and parents sitting in white chairs under these tents. After letting my 3 children loose to go play- I sit under the tent- again it is 97 degrees. About 5 minutes into sitting down the owner comes to the tent and tells everyone they have to get up. Everyone gets up and he and 3 other guys, remove each and every chair from under both tents and folds them up sitting them to the side so they cannot be used. What company provides chairs for an event and tells people they can’t use them to sit in the shade? After paying their money to bring their kids out in this heat? Both owners a husband and a wife are very rude and gaslight multiple ppl when confronted about just how evil it is to make older people sit on the ground or stand just to have some shade at an event they are throwing for children? Mind you- a majority of the people under the tents at black which means they spent their money so their kids could have fun only to be told by the owner that “he’s invested alot of money into the event” as if the paying patrons aren’t putting that money back into their pockets? Children can not be not accompanied by adults so where do they expect the parents and grandparents to sit? Most of us only saw a flyer- I personally don’t have any social media- a friend of mine sent me the flyer and NOWHERE on the flyer does it say anything about bring your own chairs and shade. I would like a refund of my money. When we were told that we’d have to sit on the wet ground or stand in order to be in the shade we left

      Our summer water Splash Fest event offers a refreshing experience with misting tents and water slides to help attendees cool off from the heat.
      To ensure fairness, we have staff monitoring the misting tents as well as signs posted that the misting tents are to walk through and cool off. Not to have chairs that were pulled from the dining tables to sit there all day. It doesn't allow other attendees to use the misting tents.
      Attendees are encouraged to bring their own chairs as the ones provided are reserved for dining at the food truck tables. Our professional staff is dedicated to making sure everyone has an enjoyable time at our event. This event is for adults and children. It is not recommended for the elderly or newborns due to the hot summer heat. It is the responsibility of the adult's to bring their own chairs if they wish to sit for long periods.

      I am rejecting this response because: no where in the flyer does it say bring your own tents and chairs. For a company to assume everyone has social media is ridiculous. For a company to put up tables where food trucks are @ 3:30 pm when the event doesn’t end until 7pm simply because they don’t want their paying customers to sit down is beyond disgraceful. For an event to charge the parents that came to watch their children, at an event geared towards children, $5 just to come into a public park, only to be told there’s no seating provided- speaks volumes of the business ethics and character of the owners, more so in the response given at the event & the response here. There’s been no accountability taken.

      Splash Fest is a fun-filled event for both children and adults which we advertise offering a variety of water activities to beat the heat and keep you cool. While we do not advertise that we provide seating in shaded areas, we do have misting tents available for all attendees to enjoy. To ensure everyone can benefit from the misting tents, we post signs that chairs are not allowed underneath them. They are only to walk through to cool off. We appreciated your understanding and encourage attendees to bring their own shading options for added comfort during hot days. Thank you for your support and feedback.

      I am rejecting this response because: The encouragement should’ve been listed ON the flyer so that parents knew- that we’d be paying $5 to sit on the wet ground or stand up and watch our children play! To ASSume that everyone has social media and that everyone saw the ONE post you made about recommending your own chairs and tents (we can view edit history) is shameful! Still no accountability. Why on earth did we pay $5 to come into a public park to have nowhere to sit let alone in a shaded area in 97degree weather @ an event geared towards children?

      On September 8th 2021, I was purchased concert tickets for Pensacola Tribute Fest from Orange Beach Breeze. Shortly after the concert was postponed to January of 2022. January X XXXX, just days before the concert was set to take place Orange Beach Breeze sent an email stating the event was cancelled completely by the city of Pensacola and we would be contacted regarding refunds. We had no contact until March 12th 2022 and was told Orange Beach Breeze was pursuing litigation against the city of Pensacola and once the process was completed we would receive refunds. There has been no correspondence since then until today April 2nd 2022. We received a final email stating there would be no refunds issued at all. Not for tickets, accommodations that were paid for, nothing. They offered to let us drive 6 HOURS to a different concert that had none of the same performers and gave us 14 days to come up with accommodations for this.

The City of Pensacola is not going to reimburse any of the losses for their cancellation, so we are unable to issue any refunds. Tickets for the Pensacola Tribute Fest that you purchased will be honored for the Space Coast Tribute Fest in Cocoa Florida at the Cocoa Riverfront Park. The dates are April 16th and 17th. It is about 6 hours away from Pensacola, but it's going to be a wonderful event. We hope to see you there. We will be sending out emails today with the information. Thank you again! You cannot hide from this. You stole our money and have made it impossible to receive it back. You closed Orange Beach Breeze and opened under **** and believe me I will blast that business too. We originally had all our events going under our new name this year as Orange Beach Breeze was just for local Pensacola events and we now have other events outside of that area. That was put in place before the City cancelled our event. It wasn't changed because of the event cancellation. Also the type of event that we had could never have been moved to Seville Square. (11 Bands in two days). The city knew that and never let us know that FEMA could come in at anytime. We stated this on the website and update. Our event requires a large amphitheater which they do not have as well as not enough parking for attendees and also tour busses. We love and welcome attendees to contact the governor as we have reached out as well to the City for what they have done by cancelling our event. It actually helps our case so thank you for that. They have cost all event planners that month a lot of money for not being upfront with us. We understand your frustration and also understand some attendees don't understand that even though it was cancelled we were liable to still pay deposits, production ect...
