I sold an item with High Noon Guns on consignment. The item was listed at $1,149.99 for a 20% fee leaving my portion of the proceeds at $919.99. The item sold in August and they refuse to honor the consignment contract by issuing a check for my portion of the sales price. I have called several times and spoke to the Office Manager named *******. He has excuses for not having the check ready every time I call. These excuses include "We've made double payments to people in the past so we have to be careful", "You're at the top of the list to be paid", "I'm not the owner so I don't know what checks have been written", "We're almost caught up and once we are then we'll pay you", "We had a change in management and we're getting used to a new system". It has been over 60 days and still I have not received my payment. I have the Florida **** Shop Consignment contract that was completed by their representative ****** ********. The control number is 4982. I have asked to speak with the owners **** and **** but they are never in the office. All I want is my share of the sale as in accordance with the consignment agreement. I have reached out to Florida Legal Match to seek the help of an attorney but only if a resolution cannot be reached with the help of BBB.Business response

In reference to this complaint, First, Yes the item was taken in on consignment August 2024. The item was on display for sale and it has been sold (not sure of exact date). That being said alot of items do not clear until the purchaser clears background checks which are required by *** regulations in the firearm industry. This basically means the sale may have not been finalized for 3 to ************************************************************** the display case does not mean it has cleared or payment for it was taken in full until picked up. Customers are notified that WE will contact them when their check is ready for pick up. Walking in, noticing it is not in the case and not having your paperwork causes alot of looking paperwork up and takes away from sales and customers on the floor, this was explained. Also, unfortunately customer caught us with additional internal issues from installing a much more efficient system that took alot of time to set up, load inventory, cross reference items paid, etc.. We asked him to work with us, I am working through this paperwork as much as possible. He will be called as soon as it is cleared and ready. Questions he can contact me directly, I am usually always in the store and do not miss calls from staff. Apologize for the delays, we are working through them. Yours will be processed as soon as possible, You will be notified by us that it is ready for pick up. Thank you. Questions, give me a call. Thank you.

I am rejecting this response because: The response from High Noon Guns is not accurate. I did receive payment from the owners personal checking account on 10/24/24 which is AFTER I asked the BBB for their help. Please see a copy of the check attached as proof of the date paid. This matter is closed but it needs to be noted that it was only resolved thanks to the help of the BBB.

On 06/26/2023 I placed a firearm of mine on consignment. The employee told me that if the firearm was sold they would take a 20% fee and it would be 2 weeks to pick up a check. After 1 month I went it to inquire on the status. I was informed the item was sold a week prior and they're waiting for the check to be signed. Since that, I've went to the location 5 times in regards to what is going on and they will not give me anymore information on when I will be paid for my item. Each time they say it was sold but can't provide a date when and no information except whenever "****" feels like writing the check he will call. I asked if I could talk to this individual because finacially I could use the money and feel two months is ample time to provide a payout for an item. If I was to **** a item they would cease ownership on the 31st day, but now that they owe me I am just out a firearm or the money indefinitely. I am concerned. Where is the firearm, why they can't provide a check, and why would it take so much time? I would like to be able to talk to "****" but employees will not honor that request. I feel I have given alot of time for this to be resolved. I would be satisfied if i was to be paid for an item that we agreed upon and was sold.Customer response
