I reached out to ERTC on Feb 3, 2023. I made the mistake of paying them $3651.57 on 6-1-23. My emails are rarely responded to and when they do respond it is to just put me off and delay contact.Initial Complaint

On 5/12/23 I had a call with ******************************* who when we spoke, I informed him we do not qualify for ERTC credit. He said with new rules we did and had colleague ******************************* reach out to me. When I spoke with *******, I also told him we do not qualify but he said under new rules we did in fact qualify and to let him show me, what did I have to lose? So I forwarded payroll records per his request.I received an Email and Phone call from ********************************* on 6/14. ******* said I had nothing to lose if I filed and was pushing me to let them file for $43,000.00 fee and I would be better paying it upfront because they charge less if I did that. When he found out I had a PEO (which ******* knew from beginning) he said well they will have to file then.I checked with PEO and my accountant again and confirmed in fact, we did not qualify for ERTC Credit and informed them. They have been calling and harassing me since telling me I need to file and show proof I filed. I informed them I would not be filing, that again as I told them from the beginning we do not qualify and they knew we did not I and believe they are running a scam and I believe they are targeting me and my husbands business because we older and may not know better.Now they have sent me a invoice for over $60,000.00 for their work.Customer response

ERTC Express have made every effort to facilitate the voluntary resolution of your past due invoice. Despite our prior communications, the outstanding payment has not been received.
I must insist once more that you remit the outstanding balance to our office and be received by 3/3/2024. Failure to do so will leave us with no alternative but to take further action.
Should we not receive your payment by the stipulated date, we will be left with no choice but to proceed with a comprehensive asset and liability investigation involving both you and your company. This investigation may entail reaching out to your vendors, suppliers, and lending institutions to assess the situation thoroughly.
Furthermore, we will be compelled to exercise our rights under the terms and conditions of the contract you signed, including the filing of UCC rights. In addition, we will recommend you be served by the local sheriff and initiate legal proceedings against your company to recover the outstanding balance, along with associated court fees.
In the interest of a swift resolution without causing any undue inconvenience or distractions, we kindly request that you provide a suitable time for us to possibly send a private investigator to your property at **************************** to verify assets.

We used ERTC Express to supposedly file the **** We went through the process with them, and they were supposed to file for it. We have been waiting for the credit. Yes, there pricing is astronomical, but we were going to do it any way. We have been waiting for 8 months with no information from them. We were ones that waited until last and not pay upfront fees. I first try to contact them with a phone call and emailed at the same time. I got a automatic reply back stating it takes 3-6 months blah blah blah and if we had questions to call the **** So, I contacted the *** to see if they had filed anything and nothing has been done at all. When I have been trying to contact them again to state what the *** said they said by email that someone from their closing department would get back with me with no further responses. I have called, emailed and finally we sent a cancelation letter to them to not proceed with anything. It just seems that they are trying to scam people into paying the fees upfront, so they get money faster. I just want to make sure that noone else gets scammed.Customer response

We have not received or heard from ERTC Express and at this time we have hired another company, but want people to be aware that they are a scam for the **** filings and to be aware that they are a scam.

ERTC Express out of the **************** took all of our business information a year and a half ago and has strung ** along stating employees who assisted us no longer work there and that forms were not sent due to negligent employees we still have not received a dime of this refund and employees suddenly disappear when they learn that we are inquiring about our status this company is extremely careless and negligent we are to receive 60k
