      back in January of 2021 we were looking to put a fence on our property. we paid a $2500 deposit. ***** came and it was difficult coordinating for the project. Budget fence advised we needed an arborist to survey the property. ***************************, certified Arborist documented that it would be thousands of dollars to replace the trees and shrubbery. far more than the fence would cost. with ***** this took over a year. in January of 22 i began requesting my deposit back. i have placed numerous calls to ******** and *****. both over time had promised me a call back which never happened. i have been led on to believe that they were handling my deposit. currently they do not call back. i am seeking my refund of deposit please. thank you

      This issue has been resolved as to client's request. 

      The representative for the client's organization provided a deposit of $2,000 not 2,500.

        Budget Fence did not recommend a tree arborist.  A tree arborist was required by the city municipality building and zoning department for compliance with Tree replacement and sustainability requirements.  Budget Fence incurred $568 dollars in permitting fees while pursuing and ultimately obtaining an approved permit.  ********************* felt the required contingencies to move forward with the fence, in regard to the tree requirements, were not cost effective for the small fencing project.  These requirements imposed by *******, made the overall cost of the project unrealistic in relation to the organization's original intentions of cost expenditure. 

      Client was made aware of the costs incurred by Budget Fence in order to obtain their approved permit.  Although the fencing project no longer made financial sense for the organization (due to the imposed requirements from Pompano relating to trees), Budget Fence produced a ready and available path to move forward with the fence project as initially proposed.  To that end, Budget Fence was empathetic to the organization's dilemma of their new imposed financial burden from the city of Pompano. 

      Budget Fence elected to waive its right to 25% of the project cost for cancellation.  Instead, Budget Fence proposed to refund the deposit, less Budget Fence's incurred costs to obtain the permit that the client organization ultimately pursued cancellation of. 

      Clients' organization agreed to Budget Fence's proposal for equitable resolution in writing, Budget Fence has processed the refund of the deposit balance.  This matter is considered resolved, as confirmed with clients' organization just prior to this response.

      To whom it may concern, I provided and submitted a response of the complaint.  After doing so, it still shows an action required.  I'm not sure what action that would be.  One of the clients desired resolutions was a deposit refund, which we've provided.  Do we need to fill that portion in somewhere?  I didn't see a way to do that, other than providing explanation in my response.  Looking forward to your feedback, so I can make sure the complaint has been completely resolved without fail.  Thanks
