      This company (Pro Painters of GA State, LLC and its agent, *****************************) is committing fraud on the public. The company website and ******** page both state that the company is licensed, bonded and insured but they are not. The companys business license is in the process of revocation for non-payment of annual fees (which has happened numerous times since the business was established in 2010) as shown on the ** Secretary of State ****************** website (#********). ****************** does not have a Residential Contractor License to perform work over $2,500 (no record on the Secretary of State Licensing website). ****************** is also providing customers a copy of a ******************* Policy which, in my case, expired before he started the work and his company is no longer serviced by that insurer. He never offered a replacement policy when his expired. Further, the company address (*********************************************************** *****) is an empty lot and planned to be an ******* City owned park. ******* the address and the news articles.) No mail can be delivered there. The address on his business license *************************************************** is undeliverable for mail. Therefore there is no way to contact the company in the case of a legal dispute or request for mediation. I have submitted a complaint to the Secretary of States ****************** and the company is being investigated now (August 2022). Lastly, ****************** intentionally under-bids contracts to get the work and then quits the job if/when he realizes he is not going to make any money (and then deleted all online traces of the estimate). I paid him $5,500 and he waited until the checks cleared the bank to return to complete the work and then fabricated an argument to give him a reason not to finish the work. The new estimate to complete the work is $6,000. Additionally, due to his workers incompetence, he destroyed my stucco wall and will now cost me an additional $7,000 to fix his damage.

      ************** gave Pro Painters $3k for materials. *** 1x8, 1x6, paint and nails were purchased completely with 3k. This ************* saw receipts for the 1x8 and rake that was $2350. ********** was $130 for 1x6. ******************************* was $350 in trim paint.  We also purchased nails, and caulking. The 3k was spent undisputed on materials. Three men including myself and a female worked eight days on your home replacing the fascia board he agreed to pay for the cost of materials and pay the labor for replacing two of the four . The labor for replacing the two was ****. The *** was estimated to cost $****. ************** was aware our measurements were estimates from 40ft on ground and they were subject to change. Fact is his *** alone cost $2500 and we bought $500 in paint and other supplies.  ************** then Paid Pro Painters $500 after we had worked 8.5 days on his homes fascia. The last two sections were to be replaced the day *** ***** accused us of denting his gutter and when shown proof by picture he insisted we fix free. His wife then assaulted the female worker and tried grabbing things out of her hand. His wife then insinuated she was going to fake some injury when u threatened to call police. ************** was still trying to get us to work as he knows we do the best work in *******.  We lost trust in ***************. I'm sorry I wont be swindled and have my workers discriminated.  I have pics of his so called stucco. It needed repair that's why he wanted us to repair it. Not replace the stucco. I told him 100x we repar stucco and it will not match ever. He had me do more than I originally agree. I agree two small areas and he want we go over all bad areas so I did to help the man. I have never had a complaint and all if his accusations are false and not in line with the facts. We are 100 percent compliant with all state laws and licensing requirements for the work we completed.

      I am rejecting this response because regardless of how much was paid to the company, the work was agreed to by verbal contract by both parties and by email by the company for $8,600 to complete the work in the written estimate - work that was failed to be completed by Pro Painters of GA State. The remedy, by law, for this is to have the work completed but in this case the company will not be permitted back on my property due to the violent/unprofessional nature of their departure. ********************** wife bruised my wife's arms and torso as she grabbed materials away that my money had purchased for the job. I have and can provide dated pictures for my wife's injuries and video evidence of the foul language ****************** used as he departed the job. ****************** regularly used profanity while on this job as he complained that the job was "killing him". ****************** was the one who threatened to harm himself on the property - not my wife, who threatened no one.

      Further:

      1) The "three men including myself and a female worked eight days on your home" really translated into about 4 hours of actual work on the days that they showed up - which were 4 days - three days were lost to crew members not being able to work, ****************** having to resolve another business dispute involving his truck and the lumber company, and when his painters were not available due to weather. I have this evidence from his text messages to me on those dates and can provide them to the BBB as needed.

      2) I paid Pro Painters $3,000 on the first day of work (June 20, 2022) as negotiated verbally with ****************** and he accepted. By the contract only 25% was due at the start of work and the remainder upon completion of the job. ****************** approached me on June 26th for more money telling me that he didn't have enough money to pay his paint crew and needed $2,000 for the painters and $500 for himself for "gas money". This paint crew, despite what ****************** may say, is part of Pro Painters and was arranged by ****************** to do the work included in the contract and within the amount agreed upon - not in addition to the $8,605 by the contract. So, I have paid Pro Painters $5,500 but as stated previously the work was not completed and, by law, the remaining work will be completed by another contractor at ********************** expense.

      3) I do admit that I blamed ****************** for the dents on my gutters (who wouldn't since I told him in writing before the job started that I didn't want dents on my gutters). On June 26th, the painters ****************** arranged for placed 5 ladders against my house front gutters to paint the dormer windows. I personally witnessed these ladders being dropped onto the gutters and pointed out the dents to ****************** that day and asked him to put bondo material on them when the gutters were to be painted later - to which he agreed to that day. The next day ****************** came to do work (on June 30th), as his crew was setting up for the day, ****************** knocked on my front door and told me he had "evidence" that the dents I mentioned previously were not made by his crew. (He had just taken pictures of the dents 5 minutes before the encounter and tried to use them as evidence of previous damage). I disputed his "evidence" as I had witnessed the ladders on the gutters in the same spots I pointed out to ****************** and told him he needed to fix the damage.

      4) ********************** wife was the one who assaulted my wife (as stated above) by pulling PVC boards out of my wife's arms. I have the dated pictures of the injuries and video evidence of this encounter filled with his wife's foul language.

      5) On the stucco work - the estimate shows pictures of several small areas that needed to be repaired at the bottom of the walls. The estimate states "Stucco repair: 1. Remove loose, flaking areas of stucco on foundation.
      2. Clean surface well. 3. Prime with bonding primer. 4. Apply cement stucco patch compound to areas with missing stucco. Areas to repair: left side of garage, backside of home." The estimate does not say the word "patch" - stucco is applied smoothly to match the surrounding surfaces but ****************** removed more than what should have been removed and then clumped on stucco patch material and let it dry before smoothing it out and now much be ground out and fixed as it should have been by ****************** originally or he should have come to me stating it couldn't be repaired. The estimate to repair ********************** damage is $7,000.

      6) While ****************** may say he and his company are "100 percent compliant with all state laws and licensing requirements for the work we completed" he has no evidence to support this statement and should be made to produce evidence. This is especially true since his business website also claims they are licensed, bonded and insured - which they are not. As stated in my complaint, ********************** business license with the ******************** of Georgia is in the process of being revoked for non-payment of annual filing requirements - and this is not the first time he has been in arrears. Since ****************** contends he has been in business since 2010, it is apparent he did work during the period when his license was revoked in 2015 and not ************************* until 2020. Second, ****************** is contracting for work to be done in excess of $2,500 without holding a Residential General Contractor License, which is against ******* ******************** law. This fact can be easily determined by looking at the ** Secretary of State Licensing website. Third, ****************** presented a copy of a liability insurance policy to me with my estimate - that policy was not renewed prior to the work being completed at my residence and no replacement insurance policy was provided to me at any time. ****************** should be made to prove insurance coverage at the time of my work or this is just another lie. 

      BBB should completely dismiss ********************** flimsy statements (as I'm sure a judge will do in the near future) and lower his BBB rating to "F" until he proves he can regain the community's trust. I do not desire any mediation unless ****************** admits fault and either pays my lawyer for the work needed to complete this contract or at a minimum refunds the $5,500 I paid to him for quitting the contract.

      It is not my burden to prove myself my company in compliance. Your accusation of our business license in progresss of being revoked shows how little you understand the things you comment on. I have several businesses and a non prophet run under my name and I am not always on time with filings. That is not a crime. Thank you for the reminder to *****. Has already been renewed. 

      2. If what you say regarding your wife were true you would have called police. I threatened to call police on your wife for putting her hands on my wife while loading our supplies in our truck.

      3. If you had any sort of truth to your case you would be able to **** You are not in the truth. You are a liar. 
      4. Please provide all checks written to Pro Painters. You paid us $3000 and $500 period

      I am rejecting this response because ****************** (representing Pro Painters of GA State) clearly doesn't understand the complaint and response process. He should understand that the burden of proof falls equally on both parties and ****************** has provided none to back up his wildly false responses to my complaint. I have provided proof of what I know to be facts in this case - the company agreed to complete work totaling $8,605. The company quit the job and failed to complete the work with no justification other than his feelings got hurt because I pointed out damage to my gutters - and was clear with him from the beginning that there were to be no damage done to the gutters (especially in the front of my house where the damage occurred) [See attached email to ******************]. Secondly, ****************** validated in his response that his business license was in arrears and in the process of being revoked at the time he did work on my property - and has provided NO proof of having the required General Residential Contractors license or having valid liability insurance at the time of his work on my property. Third, the evidence of payments to Pro Painters is irrelevant to this issue since the company failed to complete the contracted work and is responsible, by law, to complete the work (which will never happen) or PAY to have the work completed per the contract. (Because I failed to provide the BBB with evidence of my payments to Pro Painters I am attaching those as evidence in this case.) Again, ****************** will try to lie and say the check to Mr. ******* Sing-***** was not part of the contract but the crew was arranged by him to complete a portion of the contract for Pro Painters of GA State - as shown in the check note and agreed to by ******************. This payment was requested specifically by ****************** and written out to Mr. *************** at ********************** request on the date of payment - and against the contract which only required an initial and final payment. The total of payments to Pro Painters was $5,500 - so again ****************** is the liar here and has once again (after two responses) has provided no proof of his lies. The BBB should find in my behalf and annotate his BBB file with this complaint and lower his BBB rating immediately.
