      I attempted to purchase a Maximus Scooter Trike for $5,650 from Extreme Scooters on ********  I contracted to purchase this specific type of scooter trike, but this trike was no longer in stock. After waiting several months, the trike was no longer an option available for purchase. I requested my money be refunded, but Extreme Scooters attempted to force me to accept store credit instead. I have attempted to contact Extreme Scooters on numerous occasions via phone and email, to no avail. I hired an attorney who wrote letters to the business, also to no avail. My attorney is in the process of drafting a law suit but I wanted to see if this could be resolved here first.

I saw it advertised on-line and it is, still,on the *** motor sports site,so I know the scooter is out there.

      On ****** ***, I purchased a "2021' New ***** **** *** **** *** **I (Electronic Fuel Injected) ********** ******** Assembled and Tested, All Fluids, Oil and Antifreeze Serviced And Tested by ******* ********* ready for Fuel" from Dave B****** and Randy G****, dba; Extreme-Scooters.com, ******************** Dave and Randy received payment in full via a certified check, deposited to their bank account at **** ** *******. the amount of the payment was $4750.00. On numerous occasions, they pro****d a ship date and an arrival date. They pro****d to use a trucking company to transfer the ********** They pro****d that it was tested and gone over and "ready for fuel. None of this was true. They have kept my money and have now invited me to file complaints against them. This is not the first time they have defrauded people. **** **** **** **** ***** ** *** ******* ****** ** ******** ******* *** **** ***** **** *******. They told me that the water pump was "perfect" but later they told me that "the water pump needed cleaning and flushed. They broke the gear when doing this. They STILL sold me the bike and never offered a refund. They tell me that it can't be repaired. This is after I have spent $384 on NON-RETURNABLE parts to repair this unit. They told me that the "shaft was bent" and then told me that this was a typo and that the shaft is not bent. In the meantime, I purchased a shaft to repair which is not returnable. If a refund is not received by ********* ****** ***** 2023 (which they pro****d) charges will be filed with the magistrates office in Georgia.

      On **** **** I started speaking with David B****** about purchasing a scooter which I made an online request for. I had requested the ******* *********. I was told I could not purchase the total on my credit which online said they take visa. They said I could do $2,000 on $1084 I would have to do by cashier check, bank transfer or *****. Over the course of 3 days I sent the $1,084 ****** ** ****** ** **** ***** I had not received notice of my order and asked about it. I have advised the scooter I wanted was not available. He than provided me with several options. On ****, I agreed to a ******** scooter but was advised at that time I could not pay the remaining balance with credit card and would have to send the rest of the money by *****. The total was $3250. I told them due to not being able to pay by credit card, I did not want to purchase. I requested refund and they said because they told warehouse they had made delivery agreements and once that was cancelled I would receive refund of the $1,084 I paid. I continued to contact David once weekly about refund which never came. He said it would come by mail. He gave me ***** ***** number and I attempted to call and was hung up on. On **** ***** I texted and asked Mr. ***** about my refund since he did not answer phone. He said once they got scooter back I would get refund. I never got scooter and never even finalized order. I have been unable to get additional response in trying to get refund. I have everything on text message between both parties.

      When shipping from wearhouse we are dependent on there scheduling

      I mailed a check for $1194 to Dave B****** at Xtreme Scooters on **** *** 2022 and he cashed it on **** **, 2022. I never received the scooter I paid for, in spite of repeated attempts to receive the scooter I paid for or a refund of what I paid. My lawyer even sent him a threatening letter. I would like someone with leverage to force him to refund my money. I live in ****** ***** * ****** ** ********

      Negotiated a sale for a 2022 ******* *** *** for $8800 including delivery within a week to my home address. Wrote check ***** on *****/2023 for $3800 as partial payment. No delivery. After daily phone call and emails and texts- Mr Dave B****** returned phone calls and tried to sell me my much higher priced models and added assembly, shipping, and delivery. Prices over $1000. I requested refund of my $3800 partial payment on *****023. I have been calling texting and emailing on near daily basis with no response. —- and no refund.       I am rejecting this reponse because it is unacceptable.   Extreme-Scooters Mr B****** has not fulfilled their agreement ot deliver a new ******* *** UTV to me within the time he stated.    Mr Dave B****** with Extreme-Scooters agreed to deliver a new ****/23 Fully Assembled *** **** **** *** *** **** ***** *******, electric winch with added folding windshield to be delivered to ******* ***** at *** ******* ***** ********** ** for a total of $8700 as per invoice date* ** ***** 2023.  Delivery was to be within a week from that date.  He has not delivered the product as per  the agreement after 30 plus days.  

      I will accept either a full refund of $3800 or delivery of the UTV described above to my address by ** *** 2023.   

      If Mr. B****** of Extreme-Scooters wants to deliver the product in lieu of the deposit refund;  then I will pay the remaining amount upon delivery.  I cannot trust this company with any more advance payments.  

      Whatever, Mr B****** decides, I will require his agreement in writing.

      I am rejecting this response because Extreme- Scooters- Mr. Dave B****** has not delivered the ******* *** UTV as negotiated in Bill of Sale which is attached.  They can deliver the UTV as promised or REFUND my partial payment .....their no refund policy should be waived if they cannot deliver.  I did not negotiate for a more expensive or different brand of UTV.  Refund the $3800 is the correct response.

      I told Mr. ***** that we can ship the initial UTV but none of the commercial freight companies offer COD any longer. Per our Store Policy stated on his Bill of Sale he has store credit that he can use anytime for any of the products. However, in this case a cash refund is not applicable.

Then it turns out they did not have it, they had a red one. I agreed, then was told they did not have that one and would have it week of thanksgiving, then Christmas, then February . I ask for my money back and was told only store credit. Then after telling them I would be contacting BBB, FTC, and authorities Dave called me and said he wanted my address to mail a refund. On ********* I texted Dave and told him I spoke to FTC, and a attorney and was told I wired the money they "Extreme Scooter" could wire it back to me. I have herd nothing since.       he stated in the text the full amount, as per on the phone I ask him about the amount of the refund as in the text. They clearly can not produce the merchandise as promised so I would like my full money back. The store credit does me no good as I have lost all confidence in this Co. They say one thing and then do another. He stated in the text I would be refunded my full amount. That is what I would like done so I can buy the vehicle and get this over with. Store credit again does me no good and it was not what I was texted.
