We purchased 3 evergreens from Stone Creek Landscape in **********, ** on 6/9/21. They were delivered and planted the week of July 4th 2021. The trees came with a replacement guarantee and were watered per instructions of Del at Stone Creek. The pine needles fell off the first tree every time you touched it and started to die within the first month. Shortly after the other two trees started dying. I phoned Del to let him know what was happening and he no solutions to offer and was unwilling to make a trip up to look at them. It was determined that he would replace these in the spring. We contacted him this spring and went down and picked out three replacement evergreens. We were told he would deliver them on his time, but that we could go ahead and take out the dead evergreens, which we did in May at our cost. We called numerous times about deliver of the trees to no avail. By mid-summer, we asked if we could have them replaced with maple trees to which he agreed. Again, we made the trip to ********** to pick out the trees. We made several calls about delivery of these trees and were told he was short of help and they would be delivered on his time. Two weeks ago, my husband called to ask for our money back. *** told him again that he was short of help and would deliver the trees, but no refund. He finally delivered the trees on September 29th. They were not the trees we picked out. He now stated that we did not get to pick out replacement trees. He told my husband that the one hole was dry and ***** and the other two were muddy and that is the reason the trees died. The evergreens died last summer. The holes have been empty since May. Today, we received a bill from him saying that that he was billing us $1851.10 for three maple trees, and the planting and delivering. According to our warranty we do not owe anything for these trees, as they are replacements for the three evergreens that were under warranty.Business response

As far as the timing of the lose of the evergreens that has no important part in this situation. The customers asked that we wait and replant in 2022. I was having a hard time with this one customer because we sold 755 other evergreens just like their three and we never had any other dead evergreens to replace. But to have three in one place not live that is unheard of. When I saw the difference in the soil moisture then I knew why the evergreens died. If they are to dry or to wet that can and will kill evergreens.
Evan though time passed, by looking at the ground or the dirt, the soil should have been as far as wetness or dryness the same. One hole was dry as a bone and the other two were muddy.

I am rejecting this response because: It was never an option to have these trees replaced last fall. *** said we had to wait until spring. These trees died late last summer and were removed by us this spring because the seller would not come and remove them. The condition of the holes this fall have no relevance to this issue. I actually had been watering the empty spaces late this summer, as I had planted grass seed in these areas since Del had yet to deliver our trees.These trees were under warranty and Del's story keeps changing. He continually told us that he planted over 500 trees and no other trees died. He then went on to tell us about 2 incidents that he had to replace trees, but again blamed it on the customer. These trees were watered as to the instructions that were given to us from Del. We had 3 other trees planted at the same time and we have had not issues with them. We are not willing to pay for trees that were under warranty were not the trees that we had picked out. You cannot deliver trees under the pretense of replacing them and then send a bill for said trees.

At this point the customer has nothing to complain about. They have there trees that have been replaced. I will be deciding by November 1, if I am going to go to small claims.
