Hired this party to pour a cement pad in my backyard for a shed to be built on. This party failed to professionally survey the area to determine grade of slope. After this party had already dug the hole, he then put up stakes to look at what would be required to be level. All along, he indicated the pad would be 4-6 off the ground. With only a line level, he indicated the backside of the garage would be approximately 3-4 off the ground. This wasnt acceptable. I notified the party the next day and canceled the project. I indicated that the builder and the County inspector indicated he should have used a laser initially to determine the grade. This wasnt done. The party wanted to charge me an additional $150 for additional file rock. I had already paid him $800 in cash as a partial payment. I told him that I want to exchange the file rock for black dirt. Also said I wanted him to return $500 of the $800 since he failed to scope out the project before he dug the hole. He got very upset and used foul language indicating he would not do any addition work. I got him to calm down. We agreed he would remove the file rock to be used on another one of his projects and he would bring in a dump truck of black dirt in exchange for the rock. It took him three weeks to return to the project. He removed the rock and took that to another job site. He failed to remove a pile of rock on the County road. He indicated he would remove that rock. He came today to pick up his skid loader and said he would bring back good black dirt. I have his emails indicating all of this. I received an email from him and he indicated he would not bring any black dirt and I need to find another contractor. As a result, I hired another contractor and he completed the job today. He brought in a dump truck of dirt and leveled the work site. I had to pay the second contractor $1,000.00.The original contractor is incompetent and untruthful. He cant be trusted.Business response

I just received this notice in the mail today on 10/5/2022. Its was dated complaint on 9/24/2022and post marked to me on the 26th of Sept. My business notes indicates that I set up a time to work for *********************** on Aug 3. 2021. I showed up to the job as the customer (****) Had asked to on August *********, so it would match his garage builders schedule. First and foremost the customer was emailed/texted a formal estimate for his 14x 24 and driveway repair. He later claimed he found someone cheaper for the driveway and just need a garage pad. My formal bid clearly states that I need half the project amount down to cover material and it clearly states the any extra work with be addition and that I need it sign and a check before work will begin. The customer *********************** did not sign the estimate but was home and he said he could provide 1/3 of the cost to start to work. That is not normal but in good faith I started the work with $800 to get rock/cover fuel and form up the garage pad in the desired area of his yard that he had selected. One end of the garage is set to 4 about the existing yard and the north side of the garage toward to slope of the hill was going to end up around 28 or of the ground. That is not a big deal the forms and rock would complete the concrete work and the dig dug out would be graded around the foundation. ( just like every concrete project and foundation build in the world. The customer(**** stood there and watched the entire time and even tried to assist.. also, not needed.) but then realized he did not like the look and we ended up moving the garage plan 6 farther south toward the flat of the yard and away from the hillside. We formed it up and leveled everything and then the next morning on the third day he said he wanted to cancel the project and I said thats fine. I took down all my forms on the third day 9/2/2022. Note my time /fuel/ and labor is already well past $800 and on Saturday morning 8am 9/3/2022 he texted me and said that I owe him $500 back and I called and explained how I will not pay him anything back and I will come get my f****** skid loader right now. I do not owe him anything for backing out of a project before the concrete was even done. The following Monday, I needed my skid loader for paying jobs and I was driving to go get it and I called the local police. I told them the situation and that I need to pick up the skid loader and that I didnt want any issues. They said that if I have them 5 minutes they could be there to make sure there was not any problem while picking up my equipment. This call is documented with the police department, I can call and get the call report. I also stopped and talked to an officer I seen in town. He understood and agreed, that they could be there that morning as well. I did end up going to pick up my skid loader 10 minutes later and said I could be back at a better time to fix the yard. But it is not in my estimate to pay to add dirt to a customers job after they back out on a project. The original dirt was still on the customers property but placed on a hillside for free and graded. This goes into the story, he kept talking about the county coming to fix the hillside and bring him dirt to stop the erosion of his yard. His house is the only house at the end of a county road and the Atwater washes the soil away
The county has already put rip rap rock to slow the water down and he keeps requesting the do more for his land
He also notes how he hired a company to come fix his yard after I removed the rock we had placed and put the majority of the dirt back. They charged him $1000 dollars and its obvious. No ***** works for free, plain and simple. A full dump truck load of dirt alone is $550.
Its ridiculous that I can be harassed by a customer and they can try and downgrade my business when they didnt want the work completed. This is the worst customer I have ever in countered. Contractors should have to deal with this stress.Customer response

I am rejecting this response because:
i have in writing that he would remove the rock and bring in black dirt to fix his mess. I called the Sheriff and they have told him to remove the rock he left on the road. If not, the County will do so and bill him.He failed to properly spec out the grade of the slab. He even wanted to charge me for additional rock that would be needed. Clearly shows he doesnt know what he was doing before he started to dig.
I will be taking him to court. He is a hot head and wont agree to anything. His word is worthless. I also had discussed with Sheriff that I wanted them here when he removed the rock. They said they could be here in minutes if he did anything.
He lies and is incompetent.
