      The landscaping company that I found through *****'s List is ***** Welling, Welling Excavation and Landscaping, LLC. I contacted him in February of this year (2023) and on March 10, 2023, I signed the contract to have my cement patio enlarged and a small walkway installed and gave him the $1,000 down payment that he required. Since that date I haven't had any communication at all from him. He stated that he would contact me in a few days to schedule this work, but I haven't heard anything at all from him since that time. I have tried repeatedly to contact him through phone calls, texts, emails and letters and haven't had any response at all.I am very disgusted with this and am a loss as to what to do. I saved for a long time to be able to afford this work and I certainly don't want to just walk away from the $1,000 I paid him. It's been over 2 months since I paid him and don't understand why he refuses to return any of my inquiries. I am hoping that you'll be able to help get this situation resolved. I would like either the work done as contracted or have my $1,000 refunded.       I am rejecting this response because:

      As of today, June 15, 2023, nothing has been done or scheduled to complete this contracted job.  The business owner, ***** **********************, has indeed contacted us, but has only provided repeated lip service and empty promises.  He has repeatedly said he would call us to schedule this work, but he has not.  Just this morning I spoke with him and he was going to call me back in 2 hours to tell me what day he will be here to do this project.  It's now 12:35pm, 4 hours later, and I still haven't heard from him.  I believe we have been more than patient with him.  This work was contracted in early March of this year - I never expected to still be waiting just to get on the schedule, 3 months later.  So far, all that Mr ********************** has done is blow us off.  At this point I would just like an immediate refund so I can try to get another contractor.  I really needed this project to be completed and usuable before July 4th - of this year - for a family reunion.  It's probably not going to happen now.

      I would like to start off by saying we are more than happy to issue a refund to ****************. It was never our intention to allow this miscommunication and delay in project to get this far, however we understand the inconvenience it may have caused. 

      With that being said however I have attached an example of an email that we sent yesterday, prior to **************** making his request through the BBB to issue the refund. It's communication like this that shows that we were reaching out to **************** to try and resolve the matter, but he preferred to either ignore our emails or try to take matters into his own hands. 

      We would like to acknowledge that this project has taken longer than anticipated, **************** is not incorrect with that statement, however we are in our busy season now dealing with unforeseen circumstances that are out of our control. We have dealt with weather delays, and most of all supply and material problems with most of our suppliers running low and having almost all material on back order. We have spoken to other contractors in our industry who have ran into the same issue this season, and as much as we would like to be efficient and timely with our process of bidding, acceptance/payment, and project starting and being completed, unfortunately it is not always that way. We understand the inconvenience in may bring to the client, however we would like to also acknowledge that these unforeseen circumstances do not reflect our work ethic, our guarantee on our work, and most importantly our passion for satisfying the customer.

      We understand ******************** final decision to ask for a refund to be issued, we wished we could have been able to come to a different resolution, but we will move forward with improving our processes, and improving our communication.

      I am rejecting this response because:

      As I orginally indicated to you (BBB) I tried for months to get ********************** Excavation and Landscaping to communicate with us about why I had not been contacted about the delay in the job contracted.  I do have dated copies of all this correspondence.  My issue with the company has ALWAYS been that I was just left hanging with no information.  If ********************** had communicated with me it would have saved most all of this issue.  I was NOT informed of any supply or busyness of theirs.  Also, we started this contract in early March, and as I realize this is a busy time of year for outdoor work, that doesn't explain why I was not kept informed on what was happening with my contract.  Mr ********************** is a very nice and cordial man, and seems sincere in trying to make things right, but my experiece is that he doesn't follow through with what he agrees to do.  

      As to his emails that he sent regarding my refund, I did receive both of them.  However, as of this date and time (Jun 21, 2023 - 11:25 am) I have not gotten the refund check that was promised to be delivered yesterday morning.  This isn't at all surprising as I have never found that ********************** E&L follows through on what he says will be done.

      I am so sorry for all this mess!  However, seriously, it could have been avoided if I had been kept apprised of events, details and/or delays and if ********************** E & L would just have followed through on things that I was told would be done.  I gave him $1,000 on March 10, 2023 and didn't hear from him again until you (BBB) contacted him late in May despite the multiple times I tried to contact him.  Mr ********************** called it "miscommunication" , and perhaps that's the case, but that doesn't explain why we still haven't gotten the work done or had any explanation as to why.  I haven't found this company to be very reliable.  I really needed this job to be done and finished before early July and just don't want to wait any longer and continually be put off and left hanging and that's why I am asking to have the $1,000 refunded.

      Dear BBB:

      Here's an update to our situation with Welling Landscaping - Mr ***** Welling finally refunded the $1,000 deposit that we had requested after this company failed to do the landscaping  job that he had contracted with us to do.  The refund was finally given on Saturday, July 8, 2023 and I deposited it to my bank account on Monday, July 10, 2023.  It has been more than 10 days ago so it appears that the check cleared and the money is in our bank.  

      Thank you so very much for all your help in this matter!  I have no doubt that I would still be trying to get this situation resolved if not for your help.  Your attention to our complaint was prompt and thorough.  I really do appreciate all you did to resolve this situation.
