      We have a retail installment contract with ******************** that Nielsen Enterprises *** enacted. This contract is in violation of 12 CFR *******. Nielsen Enterprises *** is also in violation of advertising that a specified down payment is required. On page one of the installment contract, under the section titled sales agreement, subsection Down Payment states; You also agree to pay or apply to the cash price, on or before the date of this contract, any cash, rebate, and net trade-in value described in the itemization of the amount financed. On page 2, under Itemization of Amount Financed on line g, titled cash payment, the amount shows $2,000. There are many other violations of consumer law within this contract as well.

      I am rejecting this response because: I emailed them about this fraudulent transaction on 1/31 and they replied on 02/02/2023 asking for more information and on 02/05/2023 I emailed them all the things they violated within the contract. It is now 02/13 and I still have not received a response to this matter as to how it will be resolved. I don't want this to linger on for months with them avoiding me and this issue. I need an answer in a timely manner to cancel this contract as it is still being reported negatively on my credit report because I refuse to pay on a fraudulent contract.

      In response to your follow up, we still do not quite understand all of your allegations and the supposed violations regarding the sale and financing of your *****. You make mention of various Regulation Z sub-sections with12 CFR ******* as your lead complaint. We are confused by this because it does not apply to this type of transaction. We are open to understanding your concerns and perhaps you could explain your interpretation. You also mention that we violated some advertising regarding down payment. Down payments on finance contracts vary, but are generally required in order to qualify for financing. Similar to the first complaint, would you be more specific.

      We can respond to your last allegation concerning your purchase of the Extended Warranty. The optional extended warranty was clearly labeled on your bill of sale and finance contract as Extended Warranties + GAP. You were given a copy of it and signed for it. Our invoice to you has a separate notation showing the purchase and cost. The use of the term Extended Warranty is actually used on the *** consumer site to explain the difference between a Warranty and an Extended Warranty/Service Agreement. We do know the difference and do not mislead our clients. The actual product contract you purchased was provided to you and it clearly states it is not a warranty. The contract also states it is cancellable. If you do not want the product, you may cancel it at any time.
