I contacted Herrbach and ****************** law office in *************, ******* for expungement, on May 9th, 2022 by phone, because I live in ******** 82 miles away! Before they started working on my case they asked me to send them a check for $1,822 and told me my fingerprints are necessary and asked me to go to ******* facility to obtain them. I travelled 100 miles twice, but both fingerprints attempts were rejected. They kept on insisting that I continue taking the fingerprints although they knew that fingerprints are not required for expungement. The secretary, *********************************, blamed me and yelled to me rudely on the phone that it is my fault the fingerprints were rejected. Both ***** and *************************** were mocking me and making fun of me on the phone. They were very amused by my misery and were having fun toying with me and kicking me while Im down. They wasted my time (month and a half to be exact) while knowing that the case can be completed within 2 weeks or less. They knew from the very beginning that they wont complete my case. They found me very convenient as a victim for their fraud since I live far away and theres no way I can commute to visit the office and ruin their reputation in their city. What they did to me is a scheme to not register my request for expungement in the court system so that they can steal my money. Their office didnt provide me with any receipts or billing documents for the amount of $1,800. This means they have unsubstantiated, unreported income. So it is possible they are committing fraud and not complying with tax laws in addition to the intent to deceive me. **** ****************** stole the amount of $1,822 from me, lied to me, humiliated me and disappeared. I still havent deposited the refund check for $475 from the law office because I am relying on your help to get the full refund amount of $1,800. For more details please refer to the attached documents and word document in particular.

I am rejecting this response because:

In this reply, the attorney didnt quote the ******* expungement law where the requirements for fingerprints exist. Instead, he fabricated false requirements, generated especially for me, to steal my money.

I can prove that there are no such requirements because I have talked to 3 independent law offices in the ******* state area and they had never heard of such law that requires fingerprints for expungement.

The fact that he is repeating his lies again about the ******* requirements, proves that he lied to me the whole time and continues to do so. The money they took from me and still hold improperly is an unsubstantiated, unreported income for them. That means, they are committing fraud by not complying with tax laws in addition to the intent to deceive me.

This law office turns their clients into victims when they abuse the law and use it in their own favor. This does not coincide with the expectations of the client for professional and ethical service. Because of all that, this case will be escalated to the next level if not resolved in timely manner.

I stand by my original response previously filed. ****************************** expungement was not handled any different than another expungement we file. We always require a background check to confirm that all of the criminal history is known as you will only have one opportunity at expungement. The state provides locations where fingerprints can be taken and a background check completed. We have always had good luck with a local facility however, ************************** chose to use a facility we did not have experience with and the facility had difficulty taking the fingerprints. She then chose not to go forward with the expungement and her unused retainer was returned. There is nothing further to say regarding this complaint as all other allegations are absurd and do not require a response.
