      Dates: 4/22/23-now Amount paid: 0 What business committed to provide: A skylight placed between the rafters Nature of dispute: Eclipse began the skylight installation 4/22/24-4/23/24. Work had to be stopped to move electrical wires. I then discovered 2 problems: 1. Rafter: The installer cut a rafter, which did not need to be cut. I was not informed that rafters would be cut. 2. Framing: The skylight was not framed to ***** specifications, nor to ***. Whether business has tried to resolve the problem: At first, Eclipse said that cutting the rafter was to code & the framing was standard. After I contacted *****’s customer service representative, ***** *******, Eclipse said that they would see what they could do. On 5/2/24, the installer returned. He didn’t have a plan & asked me what I wanted. It seems that Eclipse hadn’t communicated a plan to him. A friend & I worked to come up with a plan, but this was going to take a long time. The installer left, with an understanding that he would return when we had a drawing for him. Eventually, I realized that Eclipse’s lack of a plan & their poor performance was too much for me to trust them to finish the job. On 5/6/24, I sent a letter notifying Eclipse that I would find another company to finish the job. On 5/7/24, ***** ******* agreed to come to the house to look at the job on 5/21/24. On 5/21, he recommended a 2nd *****-certified installer to finish the job. On 6/1/24, I received the estimate from *********, the 2nd installer. I believe that a fair payment includes demolition, roofing, & windows-skylights, plus the 17.69% upcharge for tax, overhead, & profit. Total: $1615.91. The president of Eclipse, ***** ********, wants me to pay for framing, possibly for the entire unfinished job, & possibly for his attorney’s fees. He has also intimated that he may send my account to collections. If possible, I would like for the BBB to determine an appropriate amount of payment.

      To whom it may concern,

      As outlined in the prior response, *** ******, from the skylight company, *****, tried to explain to her that rafter get cut. It's part of construction, especially since she wanted it centered in the room. *** ****** told her we would work with her to meet her expectations for the chute. Again, simple miscommunication on both ends on what she wanted. We had a plan that she agreed to allow us to execute the work. It's in her email response that I sent in my prior correspondence. Once we showed up, she would not allow us to finish the job. With everything that has been stated, I have nothing further to add to her malicious complaint.

      I am rejecting this response.  My original complaint (6/2/24), my response (6/9/24), and all of the attached documents contain all of the information needed.  The only additional information is that I sent a check for $1615.91 on 6/4/24 and notified Eclipse that they should receive the check on 6/5/24. It has not been deposited yet.  I have nothing further to add.
