      My home is uninhabitable due to Hurricane Ida. I contacted Pot-O-Gold Rentals, LLC, in Hammond, La., on October 26, 2021 to reserve a dumpster and was informed that it would cost $1269.00 for the first month. I was told that they would deliver sometime in the next 2 weeks. A contract which included the Terms of Service is attached. On October 29, my contractor delivered a dumpster to our home. I contacted Pot-O-Gold Rentals, LLC to cancel the dumpster and was informed that they require a 10% fee for cancellation. At no time during the initial call was I informed of a 10% service fee for cancellation or I would have paused on the rental. In the contract and Terms of Service, there is no mention of any cancellation policies. The amount of $1,142.10 (minus $126.90 service fee) was immediately credited to my account in an effort to block customers from disputing the charge. I certainly feel that this overcharge for a service fee is unreasonable and capricious. I asked why the service fee was so large, I was informed that since they charged my credit card, this was the policy and the service fee is 10%. I feel that this policy should have been told to me prior to the transaction. No dumpster was delivered to my home. The only thing that occurred was a charge to my card. I can certainly understand a $10-$15 fee for a credit card transaction; however $126.90 is taking advantage at a time of dire need. Either way, it should be a part of the written contract. Apparently Pot-O-Gold Rentals, LLC is too large to care about their customers during such a difficult time. No one in their right mind would pay a $130.00 service fee for service they did not receive. Numerous people I have spoken with agree with that sentiment. Yet, Pot-O-Gold Rentals forced me to pay an exorbitant service fee for a product that I did not receive. It would seem that a company that values their customers would do everything they could to assist during stressful times.

The account agreement that we emailed on Tuesday, October 26, 2021, at 3:01 PM was never returned to us executed. Without this document, we have no indication of the service that we will be providing is for an independent contractor (that will fall under business to business) or a consumer. Contractors can be registered under company names as well as individuals' names. You may see evidence of this by visiting the Louisiana Contractors Licensing Board. Since this agreement contains the vital information needed and the agreement is not returned signed, we will provide the requested service but will assume that the transaction is for a business. The only exception are sales taxes, for which an exemption from the state must be provided.
