      I received alert from ****** ***** that my credit score had dropped. After hours of research I learned that ******* *** **** had charged $12,663 this amount described by ***** credit card as legal fees. I immediately texted Dustin at A&H Insulation did he charge my brothers credit card. He responded no and said he would call Holden the Principle. On April 30, 2024 he next day I received an invoice and credit card receipt for the charges from the Kayla at the law firm. I was on a trip and when I returned home I went to visit my brother and ask him how much was he charged for the cleaning of his attic he stated $2,000. My brother is elderly disabled and received his education in the special education. He was not given any proposal, invoice or credit card receipt. he did not sign for any of these services or charges. He did not agree to the amount charged. He was told the job was $2,000 the employee Dustin took a picture of credit card and we never heard a word of the billing or payment. My brother has two caregivers in his home and a lawn guy I have questioned them and they are not aware of these charges. He confidents everything in this caregivers and they have no knowledge of these charges or paperwork. I have financial power of attorney which I stated to Kayla and asked who authorized these charges she responded with copies of the paid invoice and credit card receipt. This is so disappointing that an elderly disabled uneducated man could be taken by these unlicensed contractors. I have been disputing the charges with the credit card company for months and as of today this is not resolved. Looking for assistance all we agreed to was $1,200 to remove old insulation clean and sanitize the attic seal the entry points, this is small house 1200 square feet. I asked Dustin to wait a month to put the insulation to make sure the rodents where gone and all entry points sealed. I learned from the yard man who questioned them why they were removing sheet metal ducts.

      Ms. ******* has tried several avenues to dispute the charges for the work that was completed at **** *******’s house, including through ******* ***** Bank, the Louisiana State Licensing Board, and now through the BBB. So far, every avenue she has tried has ruled in our favor and no funds have been returned to **** *******. Along those lines, I have attached correspondence from our office to ****** (our credit card processing company), along with an Affidavit signed by our sales technician outlining the details of this matter, and additional exhibits to further support our position.

       

      In summary, our company was contacted to perform work on **** *******’s residence in early April. He is the sole owner of the home (see Tax Assessor printout as Exhibit “A”). The initial work was completed, the card was charged, and additional work was agreed upon (see Attachments/Exhibits). We received verbal authorization both times for the card to be charged from Mr. *******, which were witnessed by our sales technician and another officer personnel. **** contacted our office at the end of April for copies of the Invoices/Receipts and they were emailed to her immediately. On May 20, 2024, Ms. ******* advised that she had Power of Attorney over Mr. *******’s financials, and she was unaware of the charges until her credit card company notified her. Despite repeated requests for a copy of the POA, Ms. ******* has yet to provide our office with the document. Therefore, it is our office’s position that since she is not the homeowner of the residence and has not provided a Power of Attorney to date, she therefore cannot dispute the charges.

      I am rejecting this response because:

      The business response is not satisfactory for the reasons below.

       

      1-**** ******* did not contact Dustin nor A&H Insulation to work in attic. I contacted Dustin asking if he knew someone who could come out and fix a leaking shower. He offered to come fix it on Good Friday. I was out of state visiting my daughter. Dustin had recently worked in my attic in was asking for him to refer me a plumber. Once inside the house Dustin saw an opportunity to replace his insulation we never called them to come out and replace the insulation.

       

      2- the Affidavit exhibit is misleading what is the case number for the alleged A&H Insulation versus **** and **** *******. Why am I named on a legal looking document if I don’t have right to question a credit card charge? I can obtain notorized statements from caregiver yardman and roommate if we want to use this as proof.

       

      3- When did the contracting business become our word against your word? No paperwork trail leading to the charge and no paperwork given to my brother after he was charged. I had the same job done at my home about the same size for $3,416 the proposal I was required to sign before doing the work. I emailed it separately to you. 

       

      4-the response to my email request asking for signed proposal agreeing to the price was a copy of invoice and credit card charge. I never received a request for power of attorney. This Email was forwarded to Better Business Bureau and also a copy of the power of attorney.

       

      5- In regards to the contracting board they advised me to report this to the police as contractor fraud and give me the statue number but I am trying to resolve this in a civil manner before going to the police. All I want is fairness for my brother. 

       

      6- ***** bank is still in the process trying to  reslove the credit card charges. Yes I reaching out to all avenues to protect my infirm brother. 

       

      7- the verbal authorization that is mentioned is $2,000 according to my brother his caregiver and roommate.

       

      8-The credit card was charged minutes after the yardman called me to tell me that my brother was being ripped off by the contractor at his house. He said they are removing metal ducts that don’t need to be replaced. I immediately called Dustin to tell him what the yardman said and asked him what is this going yo cost he said$1,200. We never got a price of$12,663 verbal or in writing. 

       

      9- The affidavit is not correct photos emailed to prove the work was started prior to April 9 as stated.

      I am rejecting this response because: 

      They called me asked what it would take to settle. I told them to reverse the credit card charge that was not authorized and have ***** refund us the charges plus the interest accumulated at $350 per month since April and we would pay the agreed amount if $3,200. My brother wants to subtract the $1,200 of rent that Dustin collected from the tenant.

      I have not heard back from them. I told Austin the operation manger to handle through the BBB.
