In November 2023, I submitted a form with my social security number and other personal information. At that time, my husband requested to prepay for oil for one month because we are in the process of selling our home and didn't need the tank to be filled. We were assured that completing an online form would not trigger a hard inquiry. We were denied and offered the option to prepay anyway, but we decided to call back at a later date. On Saturday, January 20th, 2024, at 10:30am, my husband contacted the emergency line from his phone number to inquire about prepaying for oil as a new customer. Cristine (on the emergency line) informed him that prepayment for new customers could not be facilitated through the emergency line and suggested calling back on Monday for assistance. Shortly after our conversation with Cristine, Brian called my cell phone, stating that I submitted a form requesting a hard pull on the website at 10:30am on that Saturday, which is untrue. While on the phone with Brian, I informed Brian that I had not submitted one and would have my husband call him back. Brian gave me his personal phone number to call him back on. Later on, that day, I received a notification of a hard credit inquiry placed by Devaney Energy in my name. I want to emphasize that I did not authorize such an inquiry. I immediately contacted Brian for clarification. He indicated he could only provide information on oil delivery services and couldn't assist with credit matters. When I asked Brian why a hard pull on my account was made, he stated that a request to do so was submitted at 10:30am. I also asked Brian to provide proof that a form was submitted by me with my personal information. He refused. Submission of both hard inquiries without my consent is irresponsible and a misuse of private information. I want Devaney Energy to send me an email stating that this error was made so I can remove both hard credit inquiries (November 2023 and Jan 2024) from my name.

      Business response

      02/22/2024

Hello, we received two separate inquiries to sign up with Devaney Energy. One in November, the other in January. Both times the potential customer had to check off that they had read and agreed to our terms and conditions. I have attached our terms and conditions for your review.

Please let me know if you have any questions.

      Regards,

      Complaint: 21180845

I am rejecting this response:  My husband and I spoke to Bryan in November. Bryan stated that a soft inquiry would be made and my score would not be impacted. Despite assurances from Bryan that the November inquiry would not impact my credit score and a soft inquiry would be made, a hard inquiry was conducted without my permission. We were told that we had been rejected because of my score. As a result, we did not move forward with Devaney.
My husband called on January 20th to ask a question. Christine, the woman on the phone, informed us that they were not able to help us as they were only available for emergency services.

As I mentioned in the previous complaint, the sales representative (Bryan) that we had previously worked with called me shortly after speaking to Christine on that Saturday, despite being told by Christine that the offices were closed and they were only assisting with emergencies. I informed  Bryan that my husband had called to ask a question, and I hadn't called. To my dismay, I discovered that Bryan at Devaney (who knew me from the previous inquiry in November) had proceeded to submit a second hard inquiry on my account, utilizing my social security and private information without obtaining my consent. I want to emphasize that I neither initiated nor authorized any agreement for this second inquiry and certainly did not sign or submit anything on the website requesting one.  Bryan used my information from the previous interaction without my permission or consent. At no point did I make a request; in fact, my husband was the person who called, and he does not have my social security information. At no point did we submit anything on their website on Jan 20th. The sales representative used my personal information from the previous interaction and submitted an unauthorized credit check without my explicit consent.
It is crucial to highlight that I never requested any inquiry to be made on my behalf. The unauthorized hard credit inquiry made by their salesperson is deeply concerning and unacceptable.

      Sincerely,
      *************************
