      On Saturday, April 9th, my wife and I had a visit from our daughter, son in law and our son in laws brother. We called the restaurant about 5:30 p.m. and were told there was a 40 minute wait for dining in. After brief discussion we elected to place a carry out order for our dinners and this order was called in at ca. 5:55 p.m. We arrived at the restaurant at 6:30 to pick up our order and there was a sizable crowd waiting to be seated. There were 3 young ladies at the hostess stand, one of which went off to retrieve our order and was back in just a few minutes with our 3 bags of prepared meals (I tipped this young lady $5). My son in law paid the **** with a credit card and as we walked out he remarked that the **** was higher than expected. When reviewing the **** outside he saw there was a 17% gratuity on the **** which I said I would go back in and rectify. Inside I was directed to a manager who told me this was there policy for all carry outs of 6 meals or more. When I pointed out there were only 5 meals and an appetizer she insisted 3 times that the quesadilla was a meal although it clearly does not come with soup or salad and is located on the appetizer menu. She also said this policy was necessary since carry out traffic pulled her waitresses off the floor although clearly the young lady that assisted me was not working as a waitress and I did tip her as a matter of course. I was less than delighted when I left. After arriving back home we re-checked their web site which clearly states an 18% gratuity will be charged for dine in customers with parties of 8 or more. No mention was made of carry out gratuities, regardless of the number of meals and/or appetizers ordered. I had the feeling that this "policy" was somewhat arbitrary and predatory and that my son in law and I were cheated out of the $16.91 because it was crowded and they thought perhaps that this would go unnoticed. I would like a refund for this gratuity amount of $16.91 for my son in law.
