My business purchased a “new” 2020 Vermeer ATX530 mini articulated loader and a “new” 2021 Vermeer Log Grapple LG46 from RDO Equipment Co. Although RDO represented that the machine and equipment were “new,” I later learned that the loader was not "new" and not in good working order when it was sold. Specifically, I learned that RDO had acquired the loader from another store—knowing it had a starting issue—and asked RDO service technicians to get the loader into service, so that RDO could show the machine to me and induce me to purchase the loader and log grapple attachment for my business. Between February and August 2021, I made dozens of calls to RDO to report operation issues and non-working parts. I had to schedule service on the “new” loader multiple times. First, the quick connect couple failed, and there was a hydraulic leak. Then, the engine did not start, and the fuel lift pump had to be removed and replaced. After another hydraulic leak, a fitting had to be replaced. Despite two repair attempts, the engine continued to have starting issues. Clearly, the equipment was not fit for its intended purpose or ordinary use. In August 2021, I returned the equipment to RDO. Despite accepting the return of the goods, RDO has failed to cooperate with me in obtaining replacement goods or cancelling the installment loan agreement. In October 2021, I sent a Notice of Revocation of Acceptance to RDO, asking for RDO’s cooperation in rescinding the purchase agreement and loan agreement and filing a U.C.C. termination statement. I also asked for compensation for all payments made under the loan agreement, lost profits, and other damages suffered. To date, RDO has failed to respond.
