Had an asphalt driveway installed may of 2022. It looked terrible. They came back out and told us it would look much better after a year of driving on it. Fall 2023 it still looked terrible and now had two cracks. Ive emailed them multiple times. Filled out their online request telling them whats going on. And called and left messages. And not a single reply. They sell you on their 10 year warranty that makes them cost more than everyone else. We wanted the security of knowing we would be safe for 10 years with our investment. Its a complete scam. Ive emailed **** who was our salesman multiple times. I can share them. Ive called their phone and left messages asking for a call back. Ive filled out their online report asking for help with the driveway. 100% avoidance.Business response

Asphalt and Specialties Company installed a concrete apron to my driveway in July2022. I sent them photos of the pitting and scaling that had occurred by December and January. They advertised a 10 yr warranty and was told they go over and above other companies in that regard because most offer a 1 yr or 2 yr warranty so that is why I hired them for work. I understood they were not working in January and they told me they start in May and would reach out to me then. Ever since then I have either called or emailed on 4 occasions only to be told there is no time frame that they would get back to me after I was told I would be contacted in May. Basically it felt like I was bothering them for asking. Initially I only was seeking acknowledgment of the situation and for some to take 15 minutes to come out and look at it. I have been patient this summer and understand they may have a busy season. I followed up with them again now in September and still have no reply. I was not looking to get the work done right away but havent had any follow up and dont trust that they will get back to me. The damage done to the concrete should not happen in this short of time. I have a 25 yr old sidewalk that looks better than this 1 yr old apron. I would like to request help in this situation.Initial Complaint

ACT poured a cement patio in 2020. We had pavers there that settled and decided to replace with cement. That same summer areas had popped and also cracked. Someone came out and filled one of the holes with a product. It looked fine and was told someone would return to deal with the other holes and issues. Nobody came back. I tried to contact them but never got a response. They are closed during the winter. When snow started to melt in early 2021 the water ran back towards the house and flooded my attached garage. so when they opened in the spring of 2021 I called and sent pictures of the issue. I was told someone would be out to look at it. Nobody showed the entire summer. I made calls but was ignored. Spring of 2022 came and garage flooded again. Made calls and finally somebody came out on Monday, May 9. I could tell by his attitude things were not going to be good. He said hed look at the paperwork back at his office and get back to me no later then Friday, May 13. He finally got in touch with me today Wednesday, May 18. He had nothing but excuses why my patio failed. I told him I noticed **** mixed in with the base when they poured it and he said to me that it doesnt matter. When I asked why they bother putting base in then and just pour right over **** his response was, it is what it is and its not their problem. Also on my contract it states they will put in rebar but I dont remember seeing any. The job took 2 truck loads. The first pour is broomed one direction and the second Is broomed the opposite. That doesnt affect the cement but it looks bad and shows their lack of care. The person I dealt with is ****, Ive been told hes the owner. He said somebody will be out to fill in the holes when they have time. Im not expecting to see them anytime soon if at all from my experience in the past with them. They have a 10 year warranty but they have all the excuses not to honor it.Business response

************* called on 4/49/21 and our employee ****** meet with him. There were 5 small rock pops and a small hairline crack. ****** explained how it would get repaired, there was no discussion of drainage that he recalls. Rich would not let us do the repair unless he was there. We attempted at least twice with no answer when calling. ****** finally set a day and time to do the repair, he showed up and ************* was not there. We did not attempt again in 21. On March 5, 2022 we recieved an email concerning the drainage going back toward the garage. Once we started back to work went out and met with *************. Set a level on the patio and there was a quarter bubble slope away from the garage.
Apparantly what happened was the frost pushed the concrete up about an inch 6-8 feet away from the garage causing the slope to flow back while the frost was still in. I explained to ************* that ***** depth goes down approximately ***** inches, while our scope of work only covers the first 8". Water expands 9% by volume when frozen, which indicates there is approximately 10" of water in the first 40 to 50" under the patio.
There is an area in the landscape that holds water adjacent to the patio that would be the first thing to consider. I suggested that the area be graded to allow for runoff, which might help resolve the water problem under the patio. I also gave him another instruction book which clearly points out we have no control over frost heaving. ************* seemed to pay little if any attention to any suggestion to solve his water problem, instead blaming the concrete. But the concrete was installed properly and still is sloped properly right now. We will still repair the rock pops this season, we work that in when we can. ************* needs to understand that what he needs to do is pay attention to his water flow and make sure it all flows away and dry out so he does not get the same frost heave next year.Customer response

I am rejecting this response because:
Response is total fabrication. They poured the patio in spring 2020. It cracked and had rock pops soon after. Someone came out in 2020 and said the crack couldnt be fixed and he cut a piece off. He filled in one rock pop hole to show how it looks. I said okay and he said someone would be out later to fill the numerous holes in.Nobody showed up the rest of 2020. On February 24 2021 I sent pictures to ***** that showed the water backed ** in the garage and asked for a call. On April 4 2021 I sent another email I called and was told someone would come out to fix it. She also said it company policy not to make appointments and they would show up when they had time. Nobody came out or would return my calls the rest of 2021. This spring of 2022 water backed up into my garage again. I filled out a warranty request on their website. A person showed up last month and had nothing but excuses. When I asked why nobody came out in two season he said someone came out last year and left without doing anything. I asked why I wasnt contacted. His response was the company policy is they dont make appointments, they show ** when they can fit it in. Thats the second person from their company to tell me that. I never refused to have it repaired and I never received any calls from them like he claims in his response. He said the cracks are normal and the water backing up into my garage is my problem.His crew graded, formed and poured the patio next to an existing flower garden. Is he claiming they formed it so it causes water to be trapped? When they put the base in I noticed a few large areas that they left **** instead of a good base. I pointed them out and they said they would fix it before pouring. One of those areas is where the heaving that traps the water is at. Also, he states only 5 rock pops. There is at least 20 that very in size from a pea to a quarter. I went with them because of their 10 year warranty.
