      Fidler on the Roof did roof work for us in May 2022 and it has yet to be finished. The work so far is unacceptable both in the quality of the work as well as the appearance. Their failure to provide the work as agreed has caused various other issues which in turn have cost additional expenses. There is a signed contract and now there is a dispute about the appropriate payment owed.

      Customer has refused to allow Fidler to return to the project site to address any alleged concerns with the limited scope of Fidler’s work, which Fidler disputes.  Customer’s alleged additional expenses include costs related to pre-existing pest issues at the project site and issues with guttering outside of Fidler’s scope.  Fidler has engaged with the customer to resolve this dispute.  As of the submission of the customer’s complaint, the customer has rejected Fidler’s offers of compromise and Fidler’s mediation proposals.

      I am rejecting this response because:  It was agreed we would contact BBB to engage in alternate dispute resolution.  The work done so far on my roof has not been quality work. By their own inspection they agree we still have cracked tiles and a hole where no roofing was even put on in that spot and the mortar work done is awful looking.  I do not trust them to redo or continue to finish the job in a satisfactory manner. 

      Our complaint concerning the gutters was the amount of mortar and roofing tile pieces that were left in one main gutter causing issues of drainage and the gutter pulling away from the house. There were no pest issues at the time of their work on the roof...only after when the hole was left without roofing tile.

      Prior to the complaint being filed, Fidler offered to return to the customer’s home to perform additional work related to the scope of the parties’ contract and inspect the condition of work previously performed under the parties’ contract.  The customer advised that they did not want Fidler to return to the home.  Prior to the complaint being filed, Fidler offered to resolve the matter by accepting a reduced fee.  Customer rejected the offer.  Prior to the complaint being filed, Fidler offered to engage in mediation.  Customer advised they wanted to engage in mediation through the BBB and filed the present complaint.  After the complaint was filed, Fidler contacted the BBB and was advised that mediation through the BBB is not available.  Fidler has advised the customer that mediation through the BBB was not available.  As of this date, customer has not paid for any of Fidler’s services, has rejected Fidler’s offers to return to the site, has rejected Fidler’s offers to accept a reduced fee, and customer’s request for mediation through the BBB is not available.

      I am rejecting this response because:Because of the multiple problems and unsatisfactory work initially done, we no longer have confidence in their ability to perform adequate and satisfactory work.  We have cracked tiles, a hole in the roof, too much daylight around the eves and absolutely awful looking mortar work that noticeably stands out in our neighborhood. With the poor work done we have had raccoons as well as bats enter the home which cost us additional money to have removed. They used so much mortar it caused damage to our gutters requiring additional work and costs. To put it simply, our roof looks much worse than before they did work on it. Multiple neighbors have commented on the appearance and have asked us when we will have it fixed. I have been told that the mortar is not fixable without removing it all first and starting over..this will not be an easy or cheap fix. I was told by Fidler that the same crew would do the additional work so it is impossible to understand how they can do better work a second time around.  We have no confidence given the condition of our roof when they said the job was completed.  (only after I told them of the issues did they acknowledge the job was not actually completed).  We have made an offer that we feel is more than what should be paid for the condition they left our roof in and the costs we have incurred already as well as the future costs to fix it but for settlement purposes we are willing to do that.  We are $2500.00 apart and the mediators they suggested will cost more than $2500.00 so it makes no sense to us to spend more in mediation costs than we are apart in our negotiations.  We thought we would have an improved roof, not one that will likely cause us issues if we want to sell the house.  The work is just plain unacceptable.
