On Nov. 14, 2022, I paid the remaining balance of the 1,300 charged for a new chimney crown and chimney tuckpointing. After I sent pictures from a roofer proving that I didn't get a new chimney crown, the company installed a new chimney crown on Oct. 19, 2023. On Nov. 8, 2023, I sent pictures from a roofer proving that the new chimney crown was cracked.Business response

The original timeframe to fix the crack on the new chimney crown was the week of Thanksgiving. It has been 3 weeks since Sat., Nov 25, 2023.

Date of transaction: November 7, 2022 Amount of money paid to Roman's Tuckpointing: $550.00 What the business committed to provide me: Tuckpointing Services I went into an agreement with Roman's Tuckpointing to provide tuckpointing services on November 7, 2022. **** was my contact. Once the job started, **** left his co-workers and said he would return (which he never did that day even though I complained that same day). Around my porch area, his co-workers tuckpointed the wall (red in color) AFTER they applied sealant to the porch floor area. The some of red colored tuckpointing material fell into the porch sealant. **** and team did return to fix over a week later, but did a thick overlay of the porch sealant that had the red colored tuckpointing material. However, not only is that section thick and raised, it is a different material. I asked him to return to review and strategize as to how to fix this issue. I have reached out multiple times by telephone and text and to date, August 11, 2023, he has not responded.Business response

I am rejecting this response because: I clearly have evidence that he did not come back to fix another issue he created. The attachment named IMG 8615 shows that on November 18, I asked him to come back again because he used a different material to cover up the red mortar that fell on the original material. The attachments named IMG 8618, 8620 and 8621 (which have a date range of 3/17/23 to 8/11/23) show multiple follow *** to no avail.

TR 04/16/2024 Mediator left a detailed voicemail for the consumer requesting a complaint update for mediation.
TR 04/26/2024 Mediator sent an email to the consumer requesting a complaint update for mediation. [ CR ] No, have never heard back from them.
TR 04/30/2024 Mediator left a voicemail, and followed up with an email regarding the business response and request for the consumer to contact him directly to schedule a final visit and possible repair. [CR] He was suppose to come back almost a year ago (please see the text messages). He gave me a day and time and I waited and he never responded. I will reach out to him one more time in good faith.

TR 04/30/2024 We were hired to do this work in 2022, we have returned several times to address concerns the consumer had. This job was patch work, and we do not offer any warranty with patch work. I feel we have went above and beyond to address the consumers concerns, and even though the work was completed a year and a half ago, we will return one more time to look at the area of concern. Please have the consumer reach out to us directly to provide address and schedule a time we can look at it in the next week or two.Initial Complaint

A contract was signed between Romans Tuckpointing and me. The job was paid for before final inspection (my fault). When I inspected, I found they had not completed the windows on the east side of the home and behind the gutter on the west side, per contract. They returned and acid washed the front and completed the windows on the east side but still did not complete the tuckpointing on the west side. I emailed **** many times and he would reply: "I will try to have someone out there first thing tomorrow to take care of that for you. If not it will be until Monday" and "Sorry about that. I will try and take care of that for you this week. We have been pretty busy as of late. Due to weather we should have time this week. I will try and make it out by Wednesday." but he would never show up. Now **** is no longer responding to emails.Business response

I did the job and he paid me. Before he paid me, we did a walk around and nothing was wrong. Two days later, he called and said we forgot a small section. I sent someone over and they took care of it. Then he said there was a section behind the gutters. We do not work behind the gutters. I would have to remove a gutter to get behind the gutter. That's not in the contract. We have completed everything in the contract and everything I discussed with him.Customer response

I am rejecting this response because: This was not disclosed at any time and there were no walkarounds after the job as I paid before they completed as I had to be other places. If this were the truth, I would have removed the gutter for them. The contract states the distance to be repaired from the corner, no mention they would not repair the 3" behind the gutter. If settlement is not reached by 12/30/2022 I will be filling suit.
