I purchased an adjustable dumbbell set from this company through amazon (22 NOV 2021) and received the item a few weeks later in December 2021. Within about 2 months of purchasing this product, the weights started slipping out of the dumbbell handle and falling to the ground while I was using them, and consequently caused damage to my hardwood floor. On 12 MAR 2022 I reached out the seller/company owner who requested a video which I promptly sent him demonstrating the faulty dumbbells and he assured me I would have a replacement in the mail. I also reached out through amazon messaging and he continued to assure me the replacements would be sent (29 MAR 22). I have now waited nearly three months for the replacement and have reached out to the seller on multiple occasions. He has primarily ignored my messages and voicemails, but reponded three times to assure me they would still be coming. Of late, he simply ignores my messages. At this point, I do not believe this company intends to rectify the situation.Business response

I am a co-owner with FitNest, LLC. ******* did not notify us of a problem until months had gone by. That is why even Amazon did not give him his money back. At this point we are winding down our business and cannot issue a refund because Amazon has a hold on our account. Nor do we feel like it is fair for him to want a refund. However, when we settle everything if there is money I will issue him a refund.

I am rejecting this response because:
Unfortunately this is simply not acceptable conduct for a business and reflects a lack of accountability. Additionally, I believe this company is violating implied warranties such as the warranty of merchantability. Moreover, I believe a $750 pair of dumbbells should last more than 3 months. I would posit that any rational consumer would agree this to be a reasonable expectation. I reached out within 3 months of receiving the dumbbells after the adjustable plates began slipping out and causing damage to my floors. The dumbbells were at this point non functional. I never asked for Amazon to issue me a refund, I did ask Amazon to help me resolve this issue with fitnest because fitnest was ignoring my attempts to contact them. Additionally, I never even asked fitnest for a refund initially, I asked for a few small components of the dumbbell set to be replaced. I believe I probably had every right to ask for more and to seek compensation for damages to my house after the weights starting dropping out of the handle after only 3 months of use. At this point it seems I may need to seek legal assistance.Initial Complaint

Purchase date December 13th, 2021 by friend ***** **** for birthday present. The cost of the scooter was A mechanism on the scooter handle broke. We tried to fix it and could not. First date of contact with company was January 19th 2022. After following advice of how to "fix" the scooter, we were unable to successfully fix it and were told to send the scooter back to FitNest. We paid $40 to have scooter shipped with a return label that was sent to us by whom we purchased the product from. We have continued to make multiple attempts to contact company. Were told over and over that they would be sending a new scooter to replace broken one. (See attached document Scooter Text Messages.) The scooter was shipped back to the company February 3rd, we are still trying to get a new one 3 months later. I contacted the company for a final attempt to get the scooter on April. Was told they would send a new one (see all email documentation labeled Emails Scooter.) Was told that is was being shipped on April 21st, it is April 26th, still has not been processed by UPS. I called UPS to verify tracking #, seller lied about it being shipped, they only thing they did was create a label. When contacted today April 26th, was told that the scooter was shipped and that they would not process a refund until I sent it back. Per UPS the scooter has not been shipped. We just want out money back. If you review the attached documents you will see for yourself the unethical practices this business uses. I hope you can get this resolved asap as I am at my ends with this company. Thank you for any assistance you can have in this manner.Business response

FitNest, LLC is more than happy to resolve this problem. We were going to issue a refund and the customer told us not to and instead they were claiming a dispute on their credit card. We said ok.
Since your letter, I have tried to call on multiple occasions and left a message. I have emailed all email contacts and all have bounced back.
We are happy to make this customer happy.
