      In-ground pool was put in our backyard by this company in 2022. We recently learned the pool equipment was placed directly over our septic tank- despite them having a survey of the lot- which clearly marked the tank and lines. Now we are having to pay $700 to extend the gas line to hook up to the hot tub since the heater had to be moved. The owner of the company is taking no responsibility and refusing to pay this for us- despite being responsible. Please investigate for us!!

      Attention BBB,

      Spoke with Mr ******** this afternoon,explained In detail the efforts put in by CPC pools to help with an over two years ago construction issue just being brought to My attention . Customer signed several legal documents that any un seen objects were ?? % customers responsibility to inform company before ,customer taking full responsibility of location of pool placement and equipment location.This Placement is picked by every single client and also given to there home owners association before construction occurs  This was told a week ago when discussed with the ******** this time CPC did the ****** thing when informed at this time that neither homeowner had any idea there was anything where they decided on placement and we moved there heater at no charge for them. I will not be paying anything for this unappreciative client nor will I be bullied by the BBB. I have notated on several other complaints that I will not pay to be a member of this extortionist organization..After reading this pathetic excuse of a letter what I should do as a professional organization is file a lien on the property for work provided and let the court interpret the contract that this customer signed in several documents they were provided ..

      My suggestion for anyone using this terrible BBB site is to please do your homework first, come to our gorgeous showroom in ****** and I will be glad to discuss in great lengths of everything to be aware of how hilarious this site does there accrediting I.E competition close by with over 25 complaints last year and still have an A+ rating

      I am rejecting this response because:
      You had the lot survey with septic tank and lines clearly represented; you required this to build the pool in the first place so as not to hit anything.  I have also attached the quote from the gas company to move the line- the amount is $650+ tax.  Please contact the company (which your company recommenced) for confirmation.  Your email was incredibly unprofessional- as was your conversation with **** yesterday so no- we do not accept your response.

      After taking a moment and reviewing the file.  Each Survey submitted to me, which I have copies of and have attached, does not indicate anything about the Septic Tank location. As well, the contract signed on 4/21/21 indicates that mediation would be the 1st step if there was a dispute, and that option was never presented.  Instead, they chose the defamation route.  And again, we did go out and move the heater, free of charge.

       

      I have seen no documents backing up their claim and I am requesting that your decision be reversed.

      Pool contruction completed June 2019. The pool shell (cement/rebar) has a lifetime warranty and the plaster has a 5 year warranty. Cracks began to form in the plaster 2 years ago (2 years after construction) that resulted in water leaking out. As recommended from the owner of CPC, I had a company come out and test for leaks, which were confirmed that the crack(s) in the plaster were leaking water AND that the crack(s) appear to be structural-related. Owner of CPC, *************************, dismissed the findings and denies that the crack was leaking, blaming the company HE recommended for doing something wrong in testing and he has NEVER had a pool shell crack. The plaster company also came out and inspected the cracks, also coming to the conclusion that the pool shell is cracked. ***** continues to deny any responsibility and that his shell can't be crack because he's "NEVER HAD A POOL SHELL CRACK". during the summer of 2023, several more cracks were discovered after the hot tub was drained to fix the light (not by CPC). At least one crack goes up through the tile to the top. This 3rd company also believes the cracks are related to structural compromise. ***** continues to deny anyone's findings and refuses to fix the damages, even though it is all covered by the warranty ON THE CONTRACT. *****, and CPC, are in breach of contract. ***** sends very nasty emails, is condescending and rude. Name calling is not good business practice, but this is just my opinion. The problem is breach of contract that he attempts to remedy by having me pay for the repairs. This problem has been going on for 2 years. The hot tub needs to be re-plastered at minimum. Once the plaster is removed, the shell then can be inspected for damage. ***** refuses to do this.

      At this point letting a court interpret might be the best desired outcome...

      After giving them the CORRECT facts instead of this review I'll be honored to do whatever the court findings are..

      I am rejecting this response because:  Attached are the emails from this last week.  No threats were made and I even mentioned mediation before anything else.  He even said in the last email "Meant to agree with you Attorney will be best". 

      These emails will show his character and his attitude towards customers who have an issue with his work.  I also have every other nasty email he has sent which would show his pattern of bullying customers.  

      I have the pool crack report and the emails from ***** dismissing the findings by attacking the work and character of the person he recommended to do the crack inspection.
