I ordered a carport cover on 8/2/2021 from Carport 1 and have been waiting over 30 weeks for delivery and have not received the carport cover. Here is the latest email I sent to them to cancel the order and to refund my deposit of $1045.00. They are refusing to refund my deposit. It has been over 30 weeks and when I ordered the carport cover back in 8/21 they stated it would be only a 12 week lead time. I do have all the emails back and forth from Amanda at Carport 1 and then the final email I sent on 3/18/2022 that canceled the order and requested my refund of $1045.00 and Amanda states that the refund was not refundable.Business response

I did receive an email from Mr. ***** requesting his refund. I explained to Mr. ***** that explained to him that as a DEALER I have done my part. I also have the emails where every time he contacted me I was trying to help him out figure out when he was going to be installed.
He was put on SCHEDULE once but he foundation was not LEVEL. If the contractors make it out and they cant install then they will have to put the customer on the next trip out once they have one available. (emailed attached where CCI confirms he was on schedule and foundation was not level)
I have attached the contractor where its states the down payment is non refundable and as I previous mentioned I am not giving back a down payment for a JOB I have done.. and continue to do every time Mr. ***** calls/emails.
I can't control when they are going to put him back on schedule but as always I am willing to do my part and help out.

I am rejecting this response because:
I did not receive the carport cover within time frame stated from Carport 1 of 12 weeks. Yes the installers did show up 17 weeks instead of 12 weeks but they showed up at 4pm on a Friday and there was an issue but was told by the installers they would be right back out at 1st. They stated to contact them when the issue was fixed which I did fix issue with 2 days and tried multiple time to reach the installer and finally the installer responded that it would be after the holiday because they had vacation planned. So iI waited until after the holidays and tried to reach the again and they would not respond back on a install date. After waiting over 30 weeks from the original deposit date of 8/2/21is when I canceled the contract. I don't understand how Carport 1 can refuse the refund of $1045 when I never received the carport I ordered within the 12 weeks I was stated would be the install date.Why should Carport 1 be able to keep the deposit of $1045.00 on a carport I ordered from them and never received? This doesn't make any sense. It was to be a 12 week window on delivery not 30+ plus weeks. This is a breach of contract on their end.

I am sorry and understand the customers frustration. I am a dealer ONLY and I have done my JOB! If he wants to get the building I will continue to bother Carolina Carports Inc to try and push for the customer to get taken care of.
But I don't have any control over the schedule. He may want to touch base with Carolina Carports Inc about a discount because of the time but unfortunately the down payment is non refundable. I have done my part and will continue to do.

I am rejecting this response because:
The dealer (Carport 1) stated to me there would be only a 12 week timeframe and it was past 30 weeks when I decided to cancel the contract. So I believe they broke the contract. On top of that Carolina carport cancel twice on me. Once on 3/7/22 and the on 3/11/22. This was the point I decided to cancel the contract. So I don't understand how Carport 1 thinks they should be able to keep the deposit. They should give me back my deposit and go to Carolina carport to get their money back. How can they keep a deposit when they only completed paperwork and answered questions on follow up emails from me about when would the carport be installed which the carport was never installed.I do not want to do business with either Carport 1 or Carolina carports period! I just want my deposit back.
