I purchased a fence for my back yard from Big Jerry's, which was installed on March 28th and 29th of this year. The total cost of the fence was $8,204. When the fence was installed, the installers buried posts directly on top of painted lines marked by utility companies, without speaking to either me or my wife regarding a change in placement or any other measures to mitigate the risks of damaging buried lines. The installers ended up severing my internet cable, which was confirmed by a********* technician on March 31. When I reached out to Big Jerry's regarding the issue, they first tried to deny the issue occurred. When shown photos of the posts going directly through the painted lines simply stated that the contract states that they bear no responsibility, even though the contract also states that they would attempt to span the lines, and would carefully dig the holes if spanning was not possible. They never discussed spanning or using an alternate path for the fence with me, and obviously did not use care when digging the holes. I now expect to receive a bill from********* for the installation of a new internet line, which Big Jerry's will undoubtedly expect me to pay despite their negligence which caused the issue.Business response

Business Response /* (1000, 5, 2022/04/09) */ I have saved the letter as BBBLetter in customers file to make any addtional changes needed. Regarding the matter of ***********: We have been responding to the customers emails and have been explaining to him why we are not held responsible for the damage that occurred at his property. We have complied with our company's contract. The customer has emailed us pictures showing the fence installation. Let us know if you need them and we can also provide those to you if you want to review them. We didn't use any mechanical machinery to dig the holes. All the holes were made using the hand post hole digger. Unfortunately, as we have explained to our customer that the lines marked by the utility company aren't always directly beneath the line. These can be away of the marked lines as mentioned in the contract. Unfortunately, our customer is ignoring the contract and has decided to take it to your attention. We will attach a copy of the contract agreement that was signed which explains this. (CONTRACT) All lines that are marked by a locating service (public lines) have a grace area of 2 feet to each side of the marking. That means the line could be within a 4-foot-wide path. Big Jerry's Fencing will attempt to span that area when setting our posts. If spanning that area is not possible or practical, Big Jerry's Fencing will make every effort to carefully hand dig. In the event that we hit a line (public or private) the customer agrees that Big Jerry's Fencing is not liable for any potential costs associated with the repair of that line: (Customer initials here)
