Approximately 2 month ago I purchased a 2016 ***** equinox from drive one. They presented me a CarFax showing an excellent service record. I hadnt driven the car **** miles when the check engine light came on and the car started stalling out. I took the car to a trustworthy mechanic who told me that no oil was showing on the dipstick and they added two quarts of oil and a quart of cleaner, let it idle for twenty minutes then drained it and what came out was black as tar. He stated there is no way a vehicle with an excellent service record would have oil that looked like that after adding 3 quarts of translucent fluid to it, after all a vehicle only holds 5 quarts of oil. He said theres no way the vehicle was serviced in November as they are showing on their CarFax. This is a predatory company, targeting individuals, already struggling without remorse or conscious. These predatory companies need to be held accountable. I would have settled for them offering to pay the repair bill and walked away satisfied, but they refused. They said you bought it, its your problem not ours. To me this plainly states they are very aware, they are knowing selling less than stellar vehicles to desperate individuals. Predatory companies need to be shut down, they need to be held accountable if they sell a vehicle they cant even be driven for **** miles they should be responsible to pay for the repair bill. I had taken the vehicle to two different places both stated there is no way this vehicle was serviced correctly as the CarFax shows. CarFax is supposed to be to help consumers feel comfortable in their purchases and any company falsifying the document should be held liable. Now I am out almost a thousand dollars in repairs bill on a 2016 Equinox with with only ****** miles and an excellent service record per the CarFax. Two different mechanics at two different shops told me the damage done to the vehicle was for a repeated improper service.Business response

Hi,
I would like to first state that she purchased our vehicle AS IS with no dealer warranty. Second, we would like to state that she has a warranty through the finance company. Third, when she brought this to our attention, she had put over **** mile on the vehicle. It was her neglect that she didn't maintain the vehicle in her possession. The CARFAX records were base on previous owners. We have no responsibility on the CARFAX records.

I am rejecting this response because:
That is not correct, I hadnt even put **** miles on the vehicle. I hadnt even had the vehicle an entire month. To date, I have yet to put **** miles on the vehicle. I had two separate mechanics who explained in detail the damage to the vehicle was that the oil had not been changed in a very long time.
example: since the repair I had to make because if their negligence, Im still **** miles out on getting an oil change, my oil is still good, the vehicle in question does not burn oil, it does not use oil. I have been checking to make sure because that is what the mechanic told me to do. So to me this proves the fact that the were not honest in stating they changed oil in November and this was a well maintained vehicle. They sold a car they had not check out before they sold it. Their negligence cost me almost a thousand dollars. I have enough intelligence to know what as is means. My problem is a business selling a vehicle with extreme issues that cost the buyer thousands within a few weeks of purchase. Its bad business. Businesses should be held accountable for their services. They were negligent. They are a predatory business and that should not be legal. How is it legal to run a predatory business? We all know its not moral, but how is it legal? And then to blatantly lie about the situation? Should we not hold businesses accountable for their actions?
Sincerely,

According to our record this vehicle was sold with ****** miles on Jan.2, 2023. According to the repair record at ************* on Mar. 29, 2023 the vehicle has ***** miles on it. That gap in service is what caused for the oil to be black, as well as created an additional issues for her. I have attached the bill of sale, from when she purchased the vehicle. She is a customer that felt entitled if we're not paying for the repairs she said, "She will report ** to BBB, as well as write a bad review on the social media" and she did. Again purchasing a vehicle is not only driving, it's also maintaining the vehicle. We could go into details of why, ***** came to ** in the first place, but we leave it at that for now.
As for the *** FAX history we both have the same information that was provided by *** FAX, if there is an issues with that she can contact *** FAX.

I am rejecting this response because:
Again filled with false information. Yes that is what the mileage on the paperwork said, when I saw it I questioned it, because the vehicle had around ********************************************** dont worry about that, thats from test drives and the employees driving it home sometimes so its just not setting around, this wont make a difference. He also stated they serviced the vehicle themselves, changed the oil and the brakes. And yes, I did tell them if they dont do the right thing I will file. Businesses need to reliable, not predatory. The business preys upon the unfortunate, its more for the vehicles and its more for interest, we know that going into. But to buy a vehicle that breaks down immediately over an issue the seller would have been aware of had they actually serviced the vehicle as they stated.
I have already admitted I was backed in a corner, my vehicle had just broken down and the part for it was $8,000 and I could not afford to get it repaired, it was a Monday evening and I needed a vehicle to go to work and take my son to school and I did not have time to complete the due diligence on the vehicle and blindly trusted a used car salesman who told me I was purchasing a one owner vehicle with an excellent service record. But shouldnt we be able to trust these businesses? Is that really too much to ask for?
Sincerely,
