Vehicle purchased from CarMax **********, ** on December 6, 2023. Despite diligent efforts to rectify persistent mechanical and electrical issues through multiple service appointments, the vehicle remains defective, constituting a substantial breach of the associated warranty contract. Upon acquisition, a down payment of $10,000 was remitted, with the remaining $20,471.66 financed, inclusive of the MaxCare warranty. Since procurement, the vehicle has undergone a cumulative total of 57 days under repair across five distinct service engagements, yet essential deficiencies persist unabated. Such ongoing failure to effectuate requisite repairs unequivocally breaches the warranty terms. Critical malfunctions, including inoperative headlights, auxiliary lights, power windows, and recurrent electrical failures resulting in vehicular stalling, were immediately apparent post-purchase. Subsequent interventions necessitated repairs to the harness belt and extensive electrical rewiring. Further complications arose from a defective spare tire and catastrophic failure of the timing belt and alternator, necessitating additional expenditures for towing and repair services. CarMax's deliberate omission of material safety and mechanical deficiencies at the time of sale, including non-functional internal alert systems such as the seatbelt and turn signal chimes, contravenes North Carolina General Statutes 20- 305.1.This statute mandates full disclosure of all known material defects that affect the safety or significantly diminish the vehicle's utility or worth. Such non-disclosure fundamentally undermines consumer trust and constitutes a breach of legal obligations owed to purchasers. In accordance with the North Carolina Uniform Commercial Code (UCC) 25-2-608, governing the revocation of acceptance of goods due to breach of warranty, and the ************************* Warranty Act, 15 U.S.C. 2301 et seq., which prescribes the clear and accurate disclosure of warranty terms to consumers
