I emailed Title Boxing on 11/9/2022 informing them that I would like to cancel my month-to-month memebership. Per my contract, the business requires 30-day written notice. I received a response back from the gym on 11/9/2022 stating that "In order to cancel we have a form here at the Club that will need to be completed, at that point we can issue the 30-day notice." Their contract does not mention physically having to come to the club to cancel. I informed them that I would not be able to do that and asked that they send over a link for me to cancel online. I was informed that they did not have such a link avaialble. At that point I contacted my bank and they advised me to revoke authorization for future payments. I emailed Title Boxing on 11/29 and revoked authorization for future payments. On 12/15, Title Boxing emailed me saying "As per our conversation earlier today, I have attached a copy of your contract to this email. I am also including the link to the cancelation form below. As we have already discussed, in order for us to be able to cancel your membership you will need to fill out the cancelation form AND pay the balance of $119.99 that is currently owed for the month of December." Once again, the contract did not say anything about a cancellation form, just that I had to provide written notice, which I did. Title Boxing has continued to charge my card and now states that I owe a balance of $409.97. I have been a victim of predatory behavior by this company. After I provided the required notice of cancellation on 11/9, they have still continued to charge me. They have lied and misled me about their own policy and their various cancellation options, showing blatant disregard for my rights and well-being. This has left me feeling taken advantage of, angry, and frustrated. This type of unethical practice should not be tolerated or allowed to continue.

      To Whom It May Concern,

Ms. *** did reach out to our Club with a request to cancel her membership on the day before the payment was due in November 2022. As per our written agreement that Ms. *** signed, we require a written 30 days notice to cancel. Additionally, it is Club policy that a cancellation form be filled out in person at the Club. We explained this to Ms. *** via email. At this time, we were not informed that Ms. *** had moved. She did not come into the Club to cancel. After a second payment was declined on Ms. ***'s card, we were informed by Ms. *** that she had put a stop on the card and revoked authorization for charges. This correspondence took place on December 13th and her text message response was in response to a phone call. We responded to her text explaining that as she now informed us that she had moved out of state, we could email her the cancellation form but we she was still financially responsible for the outstanding balance. A call between Ms.*** and a member of our staff took place on December 15 where the information from previous emails and conversations was reiterated. Ms. *** stated that she did not need to inform us that she was moving and she refused to pay the past balance due or fill out the cancellation form. Therefore, as the membership cancellation form was never completed, the membership was never canceled and remained active and she has accrued the past due balance amount of 409.97. I have attached all notes and recent correspondence.

      Complaint: 1*******

I do not accept the business's response as a resolution to my complaint.

After properly notifying Title Boxing of my intent to cancel my membership via email on Nov. 9th, they refused to accept my 30-day notice and subsequently continued to charge me. This is a deceptive and predatory practice in direct contradiction of the contract I signed when joining the club.

The agreement clearly states that proper cancellation requires me to provide Box Free or Die LLC with a 30-day advance written notice of cancellation and that all dues, fees, and charges associated with my account will be expected to be paid despite the termination of service. My account was current when I notified Title Boxing of my intent to cancel. Nowhere in the contract does it state that I must visit the club in person as a condition for cancelling, which is what I was told verbally and through email. Thus, their refusal to accept my cancellation request via email is unacceptable and demonstrates unfair business practices.

I urge Title Boxing to honor the agreement we made when I joined the club and immediately cease charging me any further dues or fees related to this membership after being given proper notification of its cancellation.

Text from the contract I signed: "I understand that my membership will continue to renew monthly until I properly cancel, that proper cancellation requires me to provide Box Free or Die LLC with a 30-day advance written notice of cancellation, and that I will be expected to pay all dues, fees and charges associated with my account."

      Sincerely,
      ****** ***

      To Whom It May Concern,
It is the policy of Title Boxing Club to complete a cancellation form upon termination of a membership which is made at known at the point of enrollment. Ms. *** was informed of the policy on numerous occasions, including an immediate response to her first request to terminate her membership. As Ms.*** has refused authorization of charges through her bank, at this time we are not actively charging her card. However, past due payments are accruing and in approximately 22 days this matter will be sent to our collection agency.

This company will not allow me to cancel membership that was month to month. They continue to charge me, harass me and add fees and have not provided me with the means to cancel without going into the physical building which I am unable to do. I have asked for a form which I could have and would be able to have notarized.

      To Whom It May Concern,

As you can see in the attachments above, we have contact Ms. ******** regarding her membership status and past due amounts. We have notified Ms. ******** that her membership can be cancelled by us once the past due amount is paid. Due to be outside of the state currently, we understand that she is unable to come in to complete a cancellation request and therefore provided her with the aforementioned solution. However, Ms. ******** has refused to settle any past due amounts and therefore, the membership has not been cancelled. Once the past due amount is paid, the membership will be cancelled. Thank you.
