October 2020 SIgned a contract with civil engineering with a set price on designing a new septic system. The system was designed but an additional charge for an advanced system was apparently needed. This was stated on the original contract. Once completed had to purchase the design prior to seeing the design and proposal, and payment was made. Questions were asked to avoid the advanced system but advised by the owner that the design was the design and that was it. Obtained quotes for the system to be installed but due to lack of necessary funding, the project was put on hold. Advised Civil Engineering that the installation would need to be postponed as funding was not available, they stated fine let them know when and we would proceed. No advice to seek ***************** approvals and permits was ever mentioned. October 2021 notified the Civil engineering office that we were selling the property and would there be anything further we needed to do or if any additional funds would be needed. Reply back was nothing else needed to be done and the only other funds needed would be upon completion of installation as per contract. Property was sold in December2021 and contingent was to have septic installed after sale of house. Contractor was looking for permits in March 2022 to start work of installation. Contacted Civil Engineering to determine location of permits. Advised that an additional $250 fee would be needed to redo application and permits to health department. This application and permits were never filled out nor submitted for approval. Contract does not state anything about additional fees for this was advised that that was not the intent of the wording in the contract. Additional language states that should additnional pricing need adjusting it shall be with mutual consent. Would like my $250 back, and for them to complete the job as required from the contract with no additional charges. I have emails as proof of statements but too large to upload.
