      In 2021 I purchased my property Silver Springs Nv, intending to have a modular home constructed and convert the property to my permanent residence. I started the process with the local modular dealer and construction company “A J Homes, A J Construction”. Locally owned and operated by Angie and Josh C********. Angie referred me to **** ******** and particularly **** ********* Stating this is who they use for financing modular, and they had a very good working relationship. I blindly trusted and had faith in both entities. I deferred to their expertise and judgment, not having any knowledge myself, of construction loans, the process of modular builds, or the construction processes involved. I entered into a purchase and construction contract with AJ and started the loan process with **** ******** in March of 2021. The initial loan process was delayed. It took so long in fact that I needed to a second credit check. When I asked AJ and **** ******** what was the reason for the delay, AJ stated **** ******** wrote the loan documents wrong and **** ******** stated AJ sent the wrong information. Either way, both entities agreed a new set of documents was needed. I signed on 8/20/21, signing two set of documents. The mobile notary had to come to my place of work. AJ promptly started the “Draw process”. The first draw was issued on 9/2021. I was told numerous times over the next 18 months that my home was on order at the modular factory with various reasons for the delay. Meanwhile, every time I asked for documents or copies or details, I was referred to someone else. All parties appeared to be attempting to help but seemingly had no access to what I was asking for. Cory referred me to ***** ********** or AJ, Marie referred me to Cory or AJ, and AJ referred me to Cory or Marie. My construction phase end date was 6/2022. I asked initially about this date and was told it was simply an estimate due to a 6-month build “estimate” from AJ. It was never explained that there was a limit on construction timing. Therefore, the date passed, and not one person ever made mention of it. A second “Draw” was requested on 9/2022. The draw was authorized. Again, seemingly to me, this must be normal if **** ******** is still issuing funding. Shortly thereafter I started to have more questions. I asked on multiple occasions for any paperwork related to my build. There was none. I started attempting to contact the modular manufacturer, who was vague, and in the end, told me that they do not deal directly with customers, I had to go through AJ. I had been attempting to talk to AJ for a year. My calls went ignored or my questions were referred to **** ******** or the manufacturer. According to conversations with Marie, Cory, and several people at AJ. The manufacturer required the full cost of the modular up front, at the time of order. However, the total for the two draws was more than the modular cost. AJ told me many times they cannot start any property construction or permits without the serial number from the modular to place on the paperwork. A year and two draws later all I had was words, a construction contract, a construction loan/mortgage contract, and payments for disbursed funds that had produced nothing. Not one spec of dirt was touched on my property. On 12/20/2022 Cory contacted me by phone to inform me that the expiration/default/conversion end date of my construction loan was in two months on 2/20/2023 and no extension was available. I was in shock and very confused. Numerous questions led to further questions that have never been answered to this day and it was noticed in Jan 2023, that **** ******** did not have the second draw (Sept of 2022) wire transfer receipt documentation from AJ homes. The mobile home manufacturer never had an official “order with deposit payment” for my home. I tried to sort through the confusion. I had various phone calls, emails, and text messages trying to get documentation, answers and understand the process.

      First off I do not do business in Utah. Second off this customer cancelled her order and her deposit was returned to the finance company. We have never held anyone to a contract that they have signed if they want to cancel. We have always returned any deposits so I am not sure why she would file a complaint when she made the decision to cancel.

      Again we do not do business in Utah. Second in our contract we do not have any completion dates. Her loan contract might have expired, but we have never had a completion date because we cannot guarantee when the home will be delivered.

      I am rejecting this response because:



      Aside from the "Utah" issue, you have replied, therefore claiming knowledge and accepting the correct business Identity. 
      AJ Homes and AJ Construction are your current business entities amongst other various names and states that you have or had operated various businesses at one time. 
      Your response seems to imply that construction contracts are open ended until the end of time. As the responsible lead contractor, at some point you must start a project when you have Drawn on the construction loan funds. Disperse those funds appropriately, assigning work orders, apply for permits, and keep records. 
      Again, AJ Construction and AJ Home Center had possession of my construction loan funds for over a year and failed to start or produce anything. 
      You also seem to be implying that you paid the funds back so you don’t understand a problem. For over a year I made payments to a financial institution for those borrowed funds which also included all closing, and escrow fee’s  for a home and property build you never even started. I may have finally gotten AJ Construction to return the construction loan funds but I lost over $20,000 in associated fee’s and 2 years of my life’s plan because AJ Construction and Home Center did use said funds for my property, or home build. 
      You may continue to reply to this report with the same vague misleading statements Ive heard for 2 years now. I chose not to continue to engage with Josh or Angie Carradine or any representative for AJ Homes Center and AJ construction any further. You know what you’ve done to not just me, but many other’s, some of whom were not lucky enough to get their funds returned, is wrong.
