      I've been working with this gentleman at this office to assist with my loan modification on my home. I paid thousands of dollars to go court and provided him with my paystubs, bank statements, identification papers and everytime he supposedly went to court I paid him, he never showed me documentation showing that my loan modifications was denied and when I asked for my documents back he never provided them back to me. Told me not to pay the bank that he was talking to them and not to worry but when I finally started to distrust him and called the bank they told me they never spoke or heard of him. He lied to me from the beginning saying I wouldn't lose my home then he started changing his tune saying I should sell and he can take care of that. When the house went to foreclosure he told me would represent me in court and that he was in talks with the other side, another lie, the other side never heard of him or spoke to him. He left me high and dry and representing myself in court. Paid him also for my bankruptcy that he never did, I asked for my money back and he will not give it back and everytime I paid him it was by check and written out to him. Now I'm out thousands of dollars with no home, I'm homeless, I want my money back and documents back, my house is gone I will not get that back. I want *** him and he told me that I should just go back to my country. I want *** him and I need help. His other address is where he told me send the checks and documents to his house not to the business. His home address is ******************************************************************. When I tried to be civilized I called him to get my money and documents back he told me he no longer work with them and that he would pass the information to them. Now he just ignores my calls. I have more documents of the check stubs, couldn't attach them. Please help.

                  First let me say that if this complaint was brought to the office of Neidhardt Law,  it never would have escalated to this level. This took place at a time when Neidhardt Law began engaging in all remote labor due to Covid. This was a trying time for all and we regret any anguish regardless of cause. We are happy to refund ************** for the bankruptcy which was not filed; or if she so choses, we would happily file for her.  

                  A great deal of legal work was done in an attempt to aid **************; this is evidenced by the attachments. Most attachments, if not all, were uploaded to the courts during our defense of ************* and can be viewed in Ecourts.

                  We at Neidhardt Law engage every client with great care, concern and let the clients best interests dictate our actions and labor.

                  ************** came to us as a referral from a prior client in 2016. She was behind on her mortgage and needed Neidhardt Laws help with a modification.  When ************** hired us, she was making enough money to qualify for a modification; unfortunately, during the modification process she lost her job. We tried everything possible to get her a modification, but she never found work that paid her enough to qualify again.

                  Being that ************* could no longer qualify for a loan modification, we turned our efforts to prolonging her time in the home.  Once the home was sold, we felt it would be best for the client to file a bankruptcy;by doing so ************** would have extended her time in the home and purged any deficiency judgment. The bankruptcy filing was to take place once Landlord tenant court reached its fruition.

                  Prior to the landlord tenant process, the office received an adversarial call from ********* ******** who was insisting that her mother was not going to court and that we had done nothing to help her. She stated that whatever was going to happen, would happen regardless. It was her opinion they would be best served by letting the events play out. 

                  Neidhardt Law was contacted by the new owner who offered ************** $10,000.00 to vacate the house. Neidhardt Law conveyed the offer to ************** who said no and refused the $10,000 offer.  ************** implied that she would find a way to stay in her home. ************** was advised to take $10,000.00 but refused.

                  We heard nothing from ************** until April at which point ************** requested a refund of monies. Due to ************** rejecting our advice and, in an effort, to document all future interaction, ************** was asked to put her refund request in writing.A month later ************** made her request for a refund and was again asked to put the request in written form; said request was never received. This Better Business Bureau complaint is the only contact from ************** in two years.

                  We are happy to refund ************** for the bankruptcy, or if she so choses, we will file the bankruptcy for her. As evidenced by the attachments there was a great deal of work done for **************; the difficulty of communication during Covid created frustration for many. We are happy to help ************** reach a resolve that she finds acceptable.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because: 

      If ***** did go court why he never provided documentation to me, I want all my documents back, they didn't talk about me getting all my paperwork back.

       One ***** told me he was going file bankruptcy for me after my last court date, when it came up and I said when he was going do it he told me he couldn't because he was no longer with the firm, and during landlord tenant court when he told me I should just go back to my country instead of trying to make it in the US was very disrespectful to me. My daughter never left him a rude message I did after she told me what he told her to tell me. We never told ***** we weren't going to court.
       ***** told us that the new owner would give us $20,000 to get out and no more court, we told ***** we would take it, then he told us after the second time in landlord tenant court that it was taken off the table and no money would be given to us. He never advised us to take anything and it wasn't $10,000. 
        I was never told to put a refund in writing for my money when I spoke to ***** it was in March and he told me he couldn't help me because he was no longer with the firm but he would pass the information over to the firm.
        So before I can make a decision I need to know will I get all my documents back and all my money back and copies of the court documents of him appearing in court.
        I want all my monies back because  I sent all my checks to ***** not the firm and when he came to my house for the bankruptcy he said he didn't feel sorry for me because I'm broke and couldn't afford my home. He sold me lies and did the bare minimum and the new owner and their attorney never heard or spoke to ***** and he told me he spoke to them.and to the bank and then I find out too late he never spoke to anyone on my behalf,  all three times we went to court and he told me he would represent us or his partner would and then the week before our appearance he said I never told you that represent yourself, he was no help,  cold, uncaring and unsympathetic. 
        He should never have promised me he would save my house every time he requested money from me. When I appeared in landlord tenant court and tried to speak to the other side to find out if he spoke to ***** regarding our situation and was cursed out by that attorney it made me cry, felt so helpless and lost. I put my trust in that man who ruined my credit score im in hotel paying every week trying to find place to live, he ruined my life.

      I find that this resolution is not really satisfactory to me and the matter has not been fully resolved. I will be taking further action against ***** Ginsenan. I need my bankruptcy check and all my documents all sent to me and my court filings to my ****************************************.
