I hired top tier roofing to replace my roof. They showed up to do the work on 8/17/2023. The contracted price was $19,825. I paid $9,000 down. I have not paid the remainder of the balance due to the extent of damage done to my home by their team. They heavily damaged my new $38,000 composite deck, they caused significant damage to my landscaping, the roof has many sections which now need to be redone per other roofers inspections and they heavily damaged my siding with dents from equipment and tar stains streaked all over the house which will not come off with any solution that won’t remove the paint as well. I have significant costs to repair the damage caused by their crew. Top Tier is not willing to work with me to correct these issues. They are not willing to pay for any of the damage done to the deck or siding and are unwilling to honor the “10 year craftsmanship warranty” on the roof that is stated on my signed contract. They have essentially left me on my own to make all required repairs. I have not yet filed the paperwork to take them to court. I feel as though I am entitled to, at the very least, my $9,000 deposit back in order to deal with the roof problems that I now have no warranty to, as well as the extensive and expensive siding and deck problems that did not exist prior to 8/17/2023. Top tier did come back to my house upon my request the day after the job was completed as I called and complained of the damage and at that time, I was told, that they would be willing to pay for the damage caused. They are now not willing to do so, leaving me no choice but to take them to court. I have many photos for evidence but this platform will only allow one to be uploadedBusiness response

I would like to start this response by apologizing to anyone who has to deal with this at all. I have been in business since 2019 and have completed over 200 jobs each roofing season since we began. I have never had a complaint before and we do not intend to have any again. At TopTier Roofing, our reputation as an honest and trustworthy contractor is our main priority. We set ourselves apart in this cutthroat industry by having amazing customer service and offering top tier quality.On August 17th, TopTier Roofing arrived at Mr. ******’ property to complete both a roofing and fascia job. My crew was there from about 7:00AM until about 8:30PM. I want to first take responsibility for a few mistakes that were made on this job. We did damage a couple deck boards and we did bend about five feet of aluminum railing. There was a piece of drip edge metal that was aesthetically not pleasing. Lastly, because my crew left so late at night, there was some additional cleanup that needed to take place the next day. With that being said, Myself and two of my employees showed up to Mr. ******’ house the next day on 08/18 at about 12:30 to address these issues. Shortly after I arrived, Mr. ****** came out of his home. I introduced myself to Mr. ****** and assured him that we would fix everything we could fix right there on the spot. As far as the deck and railing go, I told Mr. ****** to get a quote from the contractor that did the work and we would happily pay for it to be fixed. As my guys were there literally doing our part in fixing this, it became clear to me that this issue would not be resolved this day. Mr. ****** stood over my guys who were on their hands and knees and degraded them. For about five minutes straight, he told them that they were losers, incompetent and that they worked for a scumbag company. After Mr. ****** said “dirty ******* *******s” for the second time, I had had enough. I told Mr. ****** that he would not be speaking to my guys this way. I told him that my guys are not less than human just because of the color of their skin. Mr. ****** became very agitated at this point and told us to “get the ****” off of his property. We complied.When myself and my employees left off of the property, Mr. ****** began harassing us. I exchanged some text messages with him until I realized there was no point in going back and forth with him. I turned it over to my lawyer to handle the situation from there on. I have made SEVERAL attempts to rectify this situation. Every offer we had made to Mr. ****** has been turned down. Mr. ****** has since accused me of going back to his house at night and keying his car. He made a comment about going to “have a talk” with a female family member of mine who lives in his neighborhood. He has been trying to blackmail me with online reviews consisting of very obvious lies. Mr. ****** has now left (and deleted) five reviews on google (each being slightly altered). Some of these reviews have been posted at two-three in the morning. He has made a post about us on the next door app. Only to be deleted after about six of my previous customers commented on it defending us. He has made up lies that we damaged all of his siding on his entire home. He has made up lies that we poked five holes in his pool which would only have been possible if one of my guys did it by hand, and if that was the case, he has video cameras all in his backyard and would be able to prove that. ( I have several pictures/screenshots of all of this that I will be sending with descriptions proving what I am saying.)After all that this man has tried to do to my employees, my company and my family, we still sent Mr. ****** more ways of settling. Mr. ****** sent my lawyer a letter stating that he would like to take me up on my original offer on august 18th. I spoke with my lawyer about this and there was no way I could be expected to return to Mr. ******’ property in hoped he would make good on his end. We sent a letter back stating that even after he had done all of this to us, we would be willing to go back, fix what we could and pay for the deck/railing. Our only ask was that Mr. ****** place the remaining balance in an escrow account held by either my attorney or a 3rd party. He denied this offer. After listening to the advice of my attorney, we decided that this matter will not be able to be resolved. Mr. ****** paid us $9,000.00 out of $19,825.00. The fascia portion of the job cost $4,850.00. This portion of the job has never even been disputed in any way. This portion is completed and satisfactory. This means that Mr. ****** paid us $4,150,00 towards the roof. My lawyer and I have decided that this matter is resolved and TopTier Roofing will no longer be bothered with this situation. The $4,150.00 is well under the amount even for roofing materials used on Mr. ******’ home. Mr. ****** still owed $10,825.00 but TopTier Roofing is allowing him to keep that money and is considering this matter closed. As far as the warranty goes, Mr. ****** never paid his contracted price, therefore never purchased one.If anyone has any questions for me, please contact me at ###-###-####.
