Suncraft was hired to install a deck and patio. I paid the first installment in July. The deck was completed but, was damaged by the workers as they were putting in the patio. They also used defective product and poor quality of finishing the skirting. The other issue is they ordered the wrong paver for the patio and claim I ordered it when I have pictures of the product I asked them to order. They now claim it doesn't exist even though I have pictures of samples from their store that I took and told them I wanted. It is also on the manufacturers website. I want them to fix the damages to the deck and use the paver I selected or reimburse me and I will find someone else to finish the project.Business response

Signed contract with Suncraft Incorporated on August 4, 2021 for construction of a sunroom addition to our house. Paid $12,600 on August 9, 2021 (Check 1185) when drawings were delivered. City of Hilliard issued permit October 28, 2021. Did not have contact from Suncraft through 11/1/2021 at which point I called and spoke to Project Manager, Jeff, who told me the project would not start until December 2021 (we expected construction would start in late October). Spoke to Jeff again on 11/22/2021 attempting to get an estimated starting date in December and was informed of a "windows backlog" of 16-18 weeks, from order date but he would not say when the windows order was placed. Would not provide an estimated date for start of construction. Was also discourteous (rude) to my wife. On January 12, 2022, called and spoke to "Jim" who told me windows were still on back order with no delivery estimate from their source. The order was placed "before Thanksgiving" but he would not provide an estimated start date. On 2/9/2022, called and spoke to "Eric", a design consultant and sales person. Windows are still on back order, will not commit to a construction start date. Note that Suncraft Industries has not contacted us once regarding a delay in the start of construction. We have no proof other than what they say is the cause of a delay in construction. We signed and paid an initial amount of $12,600 for a set of plans used to secure a construction permit by the City of Hilliard. We no longer trust this contractor to perform the work and would like to terminate the contract and receive a refund of $12,600, less permit fees. We will return the plans.Business response

As explained previously, window and door orders are taking significantly longer due to covid. When the windows and doors for your project arrive we will be ready to start construction of your sunroom. Thank you for your patience and understanding.Customer response

I am rejecting this response because: The business has repeated this since early October and the Business has not responded with a date for construction to begin. When we signed the agreement, the salesperson led us to believe the start date would be late October; in early November, we were told not to expect construction to begin until December or later. In late November, we called and were told that window and door orders were taking 16 to 18 weeks and not to expect construction until early 2022. In January, we called and were told that windows were ordered before Thanksgiving and that construction would not begin until after windows and doors were delivered. In February, we called again and were unable to obtain a date for the start of construction. Our issue boils down to the following:
1. After signing a contract on August 4, 2021 and making a $12,600 payment on August 8, 2021, with an expectation that construction would begin in late October or early November, 2021, not once has the Suncraft Industries contacted us to advise of construction delays due to availability of doors and windows.
2. In our calls to them, we have been given the same excuse that door and window availability is causing delays in the start of our project.
3. The business refuses to provide a date for the start of construction. We understand that dates slip due to weather and supply chain shortages.
4. When we request any kind of starting window, we can't even get that. If we say that we will not be home, Suncraft says that as long as they have access to the house they can start construction - BUT WHEN WILL THAT BE - and they will not provide a projected start date.
At this point, our patience has run out; we are no longer interested in this sunroom project. We have lost faith in Suncraft's ability to deliver and wish to cancel the project and have our money refunded.

Our written agreement specifically states there is no cancellation or refunds after the customer signs plans and pays the pre-construction payment. Suncraft has incurred significant expense preparing his project for construction including but not limited to the cost of drawing plans, obtaining a building permit, and ordering non-refundable windows and doors. Mr. ******* has know from the beginning that there was a significant wait time before construction would begin. He has simply changed his mind and no longer wants the sunroom and is trying to find a reason to get out of the contract. His windows and doors should be arriving in the near future and then we will be ready to start work on his project. We will notify him when we are ready to start.
